Act of the Althing

AN ACT PROVIDING FOR THE OFFICE OF VISCOUNT OF THE REALM, ITS DUTIES AND RESPONSIBILITIES.

Most Gracious Sovereign Lord and Ruler of all the Lands Whatsoever Where Man Can Smell the Scent of Saline Waters or Hear the Sound of Crashing Waves,

WHEREAS every nation where the Law rules supreme requires a well established and prescribed justice system, along with an official system for the effective and swift enforcement and application of judicial decisions;

AND WHEREAS we, Your Imperial and Royal Majesty's Most Faithful Jarls in the Althing assembled, have most joyously seen fit to make provision for the creation and establishment of such an official system to provide for the adequate and effective enforcement of judicial rulings;

NOW, THEREFORE, we, Your Imperial and Royal Majesty's most dutiful and loyal Patricians, the Most Honourable Jarls of the High Realm in the Althing assembled, have freely and voluntarily resolved to create and establish the Office of Viscount of the Realm by this Act of ours and through the provisions of the Act aforesaid prescribe its rights and responsibilities, and we do most humbly beseech Your Imperial Valtian Viking Majesty that You may be graciously pleased to assent to and confirm as Law the following decision of Your Most Faithful Althingi Jarls:

Article 1: Appointment of Viscount of the Realm
The Law Speaker of the Althing may, under his or her hand and Official Seal, appoint a Viscount of the Realm, hereafter to be referred to in this Act as "the Viscount", after consultation with the Chief Magistrate as well as the five most senior Althingi Jarls and approval of the aforesaid appointment by Resolution of the Most Honourable Jarls of the High Realm in the Althing assembled.

Article 2: Interim Appointment
In the event of the absence or incapacity of the Viscount or if that office is vacant, the Law Speaker of the Althing may appoint any qualified person to hold that office in the interim for a term not exceeding six months, and that person shall, while holding office, be paid the salary or other remuneration and expenses that may be fixed by the Law Speaker of the Althing.

Article 3: Althingi and Court Officer and Tenure
The Viscount shall be the chief executive officer of the Court of the Realm as well as of the Most Honourable Jarls of the High Realm in the Althing assembled and shall serve at the pleasure of the Law Speaker of the Althing.

Article 4: Salary and Pension
(a) The Viscount shall be paid a salary equal to seven tenths of the salary of the Chief Magistrate of the Magistrates Tribunal.

(B) After leaving office any person who has served as Viscount shall, upon application to the High Council of the Realm, be granted a pension of three-fourths of his or her pay and he or she shall enjoy the said pension for the remainder of his or her life. The High King in the High Council of the Realm may, by Order, also confer additional rewards and compensation upon a former Viscount as recognition for past service.

Article 5: Court Enforcement Functions
(a) The Court enforcement functions of the Viscount shall include but not be limited to:

collecting and enforcing Court imposed fines;

receiving and paying of bail moneys;

arrestation and presentation for non-appearance in Court;

attend sittings of the Court;

arrestation and presentation for contempt of Court;

providing security to the Court in conjunction with the Althingi Guard;

keeping order at the Court in conjunction with the Althingi Guard;

bearing the Sceptre des Requêtes;

performance of various ceremonial duties;

service of legal process;

deal with all ancillary matters relating to sudden or unexpected death;

collecting and paying costs and compensation;

grant exemptions from payment of judicial fees;

administer the estates of certain deceased persons;

execution and enforcing civil judgments;

carrying out evictions;

conducting inquests;

enforcement of maintenance orders, collecting and paying alimony;

enforcement of such other orders and judgments as may be issued by the Court.

(B) The Viscount shall have and may exercise such other Court enforcement functions as shall be conferred or imposed on him or her by or under this or any other Act.

Article 6: Althingi Functions
(a) The Althingi functions of the Viscount shall include but not be limited to:

providing security to the Althing in conjunction with the Althingi Guard;

keeping order at the Althingi Jarls' meetings in conjunction with the Althingi Guard;

arrestation and presentation for non-appearance before the Althing;

attend sittings of the Most Honourable Jarls in the Althing assembled;

bearing the Black Rod of Valtia;

arrestation and presentation for contempt of the Althing;

managing the Althingi Page Program;

performance of various ceremonial duties;

service of Althingi writs of summons.

(B) The Viscount shall have and may exercise such other Althingi functions as shall be conferred or imposed on him or her by or under this or any other Act.

Article 7: Co-Operation with Other Authorities and Organizations
The Althingi Guard and the police services shall co-operate with the Viscount. Other authorities and organisations whose activities concern any of the Viscount's functions shall support the Viscount in the exercise of the functions aforesaid.

Article 8: Viscomital Delegation of Functions
The Viscount may delegate any of his or her functions, other than this power of delegation, to any Viscount's Deputy or to any person prescribed by the regulations or belonging to a class so prescribed.

Article 9: Viscount's Department
There shall be a Viscount's Department to assist the Viscount in the discharge of his or her functions. With the approval of the Law Speaker of the Althing, the Viscount shall appoint such Viscount's Deputies and other employees to the Viscount's Department as he or she considers necessary for assisting him or her in the discharge of the functions of the office of Viscount. The aforesaid staff shall be appointed at such remuneration and on such other terms and conditions as the Law Speaker of the Althing may determine.

Article 10: Jurisdiction and Powers
(a) The Viscount shall have jurisdiction throughout the whole of the Twenty-Six Jarldoms to exercise all the powers and perform the functions conferred upon him or her under Althingi Law.

(B) The Viscount as well as any Viscount's Deputy shall have the same powers as a police officer under the Law of the Land and may carry firearms and make arrests without warrant for any offense against the High Realm committed in his or her presence, or for any crime cognizable under Althingi Law if he or she has reasonable grounds to believe that the person to be arrested has committed or is committing such crime.

Article 11: Hindrance or Obstruction of Persons Exercising Viscount's functions
(a) Anyone who hinders or obstructs, or attempts to hinder or obstruct, or in any way interferes with the Viscount or a Viscount's Deputy in the exercise of any of the Viscount's s functions, shall be guilty of the crime of Hindrance and shall upon conviction thereof be liable to the punishment of Intermediate Outlawry.

(B) In the event that death results from the violation of this Article, or if the violation includes kidnapping or an attempt to kidnap, aggravated sexual abuse or the attempt to commit aggravated sexual abuse, or an attempt to kill, the defendant shall be upon conviction thereof be liable to the punishment of Full Outlawry or to the death penalty.

Article 12: Regulations
Each tribunal of the Court of the Realm may, the Magistrates Tribunal by Act of Adjournal and the Althings Tribunal by Act of Sederunt, may make regulations, not inconsistent with this Act, for or with respect to any matter that by this Act is required or permitted to be prescribed or that is necessary or convenient to be prescribed for carrying out or giving effect to this Act.

Article 13: Short Title and Commencement
This Act may be cited as the Act on the Viscount of the Realm of Year 13 and shall come into operation immediately after it has received the Imperial Assent.

In consequence of Us looking with favour upon the decision of the Althing of that Day of the Ladies Divine Frigga, Freyja and Idunn, Fulltrui and Sacred Queens of Stormark since time immemorial, which is known to Us, Our Well-Beloved Royals, Nobles, Knights and Thegns, and all Our other Well-Beloved Patricians and Citizens whatsoever as the Sixth Day of the Month Himinbjorg in the Thirteenth Year of the Second Viking Age in the Second Epoch of Our High Realm that the Law Speaker of the said Althing has most graciously laid before Us, We have assented to and confirmed, as We hereby do assent to and do confirm the same as Law under Our Hand and the Great Seal of Our High Realm.

Given at the Court of the Three Ladies Divine, since time immemorial situated at the Vanadísarhall on the holy island in the sacred river Fulltrui Flow known as Hnossa Isle which is seated within the bounds of the Imperial City of Haraldsborg in Our Jarldom of Gularike, on this Day of the Ladies Divine Frigga, Freyja and Idunn, Fulltrui and Sacred Queens of Stormark since time immemorial, the Sixth Day of the Month Himinbjorg in the Thirteenth Year of the Second Viking Age in the Second Epoch of Our High Realm.
