Act of the Althing

AN ACT TO MAKE PROVISION FOR ENSURING ECONOMY, EFFICIENCY, INTEGRITY AND EFFECTIVENESS IN THE USE OF PUBLIC MONEY BY DEPARTMENTS OF THE IMPERIAL GOVERNMENT AND OTHER AUTHORITES AND BODIES.

Most Gracious Sovereign Lord and Ruler of all the Lands Whatsoever Where Man Can Smell the Scent of Saline Waters or Hear the Sound of Crashing Waves,

WHEREAS Your Imperial and Royal Majesty has been graciously pleased to signify to Your Most Faithful Jarls in the Althing assembled that Your Imperial and Royal Majesty is desirous that consideration should be given by Your Most Faithful Althingi Jarls to provision for the ensuring of the good and proper use of the monies and resources which we, the Most Honourable Jarls of the High Realm in the Althing assembled, have cheerfully granted to Your Imperial Valtian Viking Majesty;

AND WHEREAS Your Imperial and Royal Majesty has further been graciously pleased to signify that Your Imperial Valtian Viking Majesty is desirous that there should be provided for a State Comptroller and Auditor General of the High Realm for carrying out the noble task of auditing the public finances of the High Realm;

NOW, THEREFORE, we, Your Imperial and Royal Majesty’s most dutiful and loyal Patricians, the Most Honourable Jarls of the High Realm in the Althing assembled, have freely and voluntarily resolved to make such provision as hereinafter appears for the purposes aforesaid, and we do most humbly beseech Your Imperial Valtian Viking Majesty that You may be graciously pleased to assent to and confirm as law the following decision of Your Most Faithful Althingi Jarls:

Article 1: Appointment of State Comptroller and Auditor General of the High Realm
The High King in the High Council of the Realm shall, by Order, appoint a State Comptroller and Auditor General of the High Realm, hereafter to be referred to in this Act as "the State Comptroller", after consultation with the five most senior Althingi Jarls and approval of the aforesaid appointment by Resolution of the Most Honourable Jarls of the High Realm in the Althing assembled.

Article 2: Interim Appointment

In the event of the absence or incapacity of the State Comptroller or if that office is vacant, the High King in the High Council of the Realm may appoint any qualified auditor to hold that office in the interim for a term not exceeding six months, and that person shall, while holding office, be paid the salary or other remuneration and expenses that may be fixed by the High King in the High Council of the Realm.

Article 3: Tenure and Prohibition of Re-appointment

The State Comptroller shall hold office during good behaviour for a term of 10 years but may be removed for cause by the High King in the High Council of the Realm on Address of the Most Honourable Jarls of the High Realm in the Althing assembled. Once having served as the State Comptroller, a person shall not eligible for re-appointment to the office aforesaid.

Article 4: Salary and Pension

(a) The State Comptroller shall be paid a salary equal to the salary of the Chief Magistrate of the Magistrates’ Tribunal.

(B) After leaving office any person who has served as State Comptroller shall, upon application to the High Council of the Realm, be granted a pension of three-fourths of his or her pay and he or she shall enjoy the said pension for the remainder of his or her life. The High King in the High Council of the Realm may, by Order, also confer additional rewards and compensation upon a former State Comptroller as recognition for past service.

Article 5: Staff of the State Comptroller
The State Comptroller shall appoint such staff to him or her as he or she considers necessary for assisting him or her in the discharge of his or her functions. The aforesaid staff shall be appointed at such remuneration and on such other terms and conditions as the State Comptroller may determine.

Article 6: Resources for the State Comptroller

(a) The State Comptroller shall, out of monies provided by the Most Honourable Jarls in the Althing assembled, be provided with sufficient resources to carry out his or her functions. He or she shall for the financial year known as the Fourteenth Year of the Second Viking Age and each subsequent financial year prepare an estimate of the use of the aforesaid resources and lay it before the Most Honourable Jarls in the Althing assembled.

(B) The State Comptroller may make a special report to the Althing Jarls in the event that amounts provided for his or her office in the estimates submitted to Most Honourable Jarls in the Althing assembled are, in his or her opinion, inadequate to enable him or her to fulfil the responsibilities of his or her office.

Article 7: Independence of State Comptroller

The State Comptroller shall the auditor of the accounts of the High Realm, including those relating to the General Revenue Fund, the Strategic Reserve Fund and the Currency Fund, and as such shall make such examinations and inquiries as he or she considers necessary to enable him or her to report as required by this Act. Subject to Althingi Law, the State Comptroller may not be directed on how any function of the office of State Comptroller is to be carried out.

Article 8: State Comptroller to Ensure Compliance with Law

It shall be the duty of the State Comptroller to provide the Most Honourable Jarls in the Althing assembled with independent assurance that the public finances of the High Realm are being regulated, controlled and supervised and accounted for in accordance with Althingi Law and that the provisions of this Act are being duly complied with.

Article 9: State Comptroller to Ensure Proper Spending and Collection

The duty mentioned in the preceding Article shall be taken to include, in particular, assuring the Most Honourable Jarls in the Althing assembled, that money withdrawn from the General Revenue Fund, the Strategic Reserve Fund or the Currency Fund was used for the purpose for which it was authorized to be withdrawn and that all income due to the High Realm has been collected or otherwise duly accounted for.

Article 10: State Comptroller to Report on Althingi Funded and Aided Bodies

The duty mentioned in the Article 8 shall also be taken to require the State Comptroller to consider and report to the Most Honourable Jarls in the Althing assembled on:

(a) the effectiveness of the internal financial controls of Althingi funded bodies and the internal auditing of those controls;

(B) the economy, efficiency, integity and effectiveness in the way Althingi funded bodies use their resources;

(c ) the effectiveness of the internal financial controls of Althingi aided bodies and the internal auditing of those controls;

(d) the economy, efficiency, integity and effectiveness in the way Althingi aided bodies they use their resources.

Article 11: State Comptroller's Report

The State Comptroller shall prepare an annual report in respect of the activities of the office of State Comptroller and Auditor General of the High Realm and provide a copy of each such report to the High Council of the Realm and to the Most Honourable Jarls in the Althing assembled. He or she may also make special reports to the Althingi Jarls on any matter of pressing importance or urgency that, in the opinion of the State Comptroller, should not be deferred until the presentation of the next annual report.

Article 12: Access to Information and Stationing of Officers in Departments

(a) Save as provided by any other Act of the Althing that expressly refers to this Subarticle, the State Comptroller is entitled to free access at all convenient times to information that relates to the fulfilment of his or her responsibilities and he or she is also entitled to require and receive from members of the Imperial Public Administration any information, reports and explanations that he or she considers necessary for that purpose.

(B) In order to carry out his duties more effectively, the State Comptroller may station in any department of the Imperial Public Administration as well as any other Althingi funded or aided body any person employed in his office, and such department or body shall provide the necessary office accommodation for any person so stationed.

Article 13: Short Title and Commencement
This Act may be cited as the Act on the State Comptroller and Auditor General of the High Realm of Year 13 and shall come into operation immediately after it has received the Imperial Assent.

 

In consequence of Us looking with favour upon the decision of the Althing of that Day of the Ladies Divine Frigga, Freyja and Idunn, Fulltrui and Sacred Queens of Stormark since time immemorial, which is known to Us, Our Well-Beloved Royals, Nobles, Knights and Thegns, and all Our other Well-Beloved Patricians and Citizens whatsoever as the Thirty First Day of the Month Sessrumnir in Folkvanger in the Thirteenth Year of the Second Viking Age in the Second Epoch of Our High Realm that the Law Speaker of the said Althing has most graciously laid before Us, We have assented to and confirmed, as We hereby do assent to and do confirm the same as Law under Our Hand and the Great Seal of Our High Realm.

Given at the Court of the Three Ladies Divine, since time immemorial situated at the Vanadísarhall on the holy island in the sacred river Fulltrui Flow known as Hnossa Isle which is seated within the bounds of the Imperial City of Haraldsborg in Our Jarldom of Gularike, on this Day of the Ladies Divine Frigga, Freyja and Idunn, Fulltrui and Sacred Queens of Stormark since time immemorial, the Thirty First Day of the Month Sessrumnir in Folkvanger in the Thirteenth Year of the Second Viking Age in the Second Epoch of Our High Realm.
