Act of the Althing

AN ACT ON DECLARATIONS OF LEGAL DEATH.

Section 1: Preliminary provisions
Upon an absence of 200 days, a Patrician or resident of Stormark ("the absentee") shall be declared legally dead by a responsible Warden of the High Council of the Realm (“the warden”), provided that:


a) the absentee has not prior to the absence informed the government of the High Realm that he or she was taking a leave of absence from the High Realm and that information then provided did not indicate a time of when that absence would stop, or


B) the absentee is not known to participate actively in another micronation that is recognized by the High Realm either de facto or de jure.

Section 2: Interested parties
The Warden shall only declare the absentee legally dead if a petition to do so comes from:


a) a relative, by blood, house, union or marriage of the absentee, or


B) a person in a direct line of succession to any title or office of the absentee, or


c) a person named in a last will and testament of the absentee, or


d) a person with whom the absentee has entered into a contract or agreement, or


e) a person with whom the absentee has a contentious dispute.

Section 3: The Warden’s Procedure
I. The Warden shall upon finding that all conditions are met in a petition to declare the absentee legally dead issue a certificate of legal death for the absentee. This certificate will enter into force ten days after the issuance. During the ten days of limbo, the certificate (and its effect) may be appealed to the Magistrates’ Tribunal by an interested party.

II. Should no certificate be issued by the Warden, the petitioner may appeal the measure to the Magistrates’ Tribunal within ten days of the warden’s decision.

Section 4: Petitions Directly to the Magistrates’ Court
I. A Patrician or legal resident of Stormark may, by the Magistrates’ Tribunal, be declared legally dead, notwithstanding Sections 1 to 3, upon a petition from the High Council of the Realm or of a party named in the list in Section 2, when special circumstances beyond the normal procedure in Section 1 to 3 may demand it.

II. Such special circumstances may include (but is not necessarily limited to):

a) the desire of a Patrician to assume a new character or sim-ID in the High Realm,


B) the knowledge of a real-life death of a Patrician or legal resident in the High Realm, or


c) no person named in Section 2 exists so the High Realm assumes responsible to petition for a death of a Patrician or legal resident after the 200 days of absence.

Section 5: Clarifications
I. In any case by the Magistrates’ Tribunal, the Chief Magistrate shall sit alone, due to the fact that the respondent, the absentee, cannot make his or her representations known. A petition to declare someone dead must be considered a waiver of the right to appoint a magistrate ad hoc.

II. A micronation recognized de facto by the High Realm is defined, for the purposes of this Act, to be any State, with which the High Realm has no diplomatic ties or agreements, that is a member of an international or intergovernmental organization of which the High Realm also is a member.

III. The responsible Warden is the Warden of Council appointed by the High Justiciar to make rulings under this Act.

Section 6: Citation and enactment
This Act, which may be cited as the Legal Death Act of Year 13, enters force upon the High King’s assent and promulgation.

 

In consequence of Us looking with favour upon the decision of the Althing of that Day of the Ladies Divine Frigga, Freyja and Idunn, Fulltrui and Sacred Queens of Stormark since time immemorial, which is known to Us, Our Well-Beloved Royals, Nobles, Knights and Thegns, and all Our other Well-Beloved Patricians and Citizens whatsoever as the Thirty First Day of the Month Sessrumnir in Folkvanger in the Thirteenth Year of the Second Viking Age in the Second Epoch of Our High Realm that the Law Speaker of the said Althing has most graciously laid before Us, We have assented to and confirmed, as We hereby do assent to and do confirm the same as Law under Our Hand and the Great Seal of Our High Realm.

Given at the Court of the Three Ladies Divine, since time immemorial situated at the Vanadísarhall on the holy island in the sacred river Fulltrui Flow known as Hnossa Isle which is seated within the bounds of the Imperial City of Haraldsborg in Our Jarldom of Gularike, on this Day of the Ladies Divine Frigga, Freyja and Idunn, Fulltrui and Sacred Queens of Stormark since time immemorial, the Thirty First Day of the Month Sessrumnir in Folkvanger in the Thirteenth Year of the Second Viking Age in the Second Epoch of Our High Realm.
