Act of the Althing

AN ACT TO MAKE FRESH PROVISION CONCERNING THE PUNISHMENTS FOR CRIMES COMMITTED UNDER STORISH LAW; TO MAKE PROVISION CONCERNING CRIMINAL FORFEITURE; TO MAKE PROVISION CONCERNING WEREGILD; AND TO PROVIDE FOR MATTERS CONNECTED TO THE AFORESAID.

Article 1: Penalties
The following shall be the penalties for crimes committed wherever Storish Law applies:

• Lesser Outlawry;

• Intermediate Outlawry;

• Full Outlawry; and

• Death.

Article 2: Lesser Outlawry
Anyone who has been convicted of a crime that carries the penalty of Lesser Outlawry shall be liable to undergo a term of penal servitude fixed by the Court not exceeding three years, or a fine not exceeding ten penalty units, or both.

Article 3: Intermediate Outlawry
Anyone who has been convicted of a crime that carries the penalty of Intermediate Outlawry shall be liable to undergo a term of penal servitude fixed by the Court not exceeding seven years, or a fine not exceeding three hundred penalty units, or both.

Article 4: Full Outlawry
Anyone who has been convicted of a crime that carries the penalty of Full Outlawry shall be liable to undergo a life term of penal servitude, a term of penal servitude fixed by the Court not exceeding twenty-five years, or a fine not exceeding five thousand penalty units, or both one of the aforementioned terms of penal servitude and the aforesaid fine.

Article 5: Death Penalty
Anyone who has been convicted of a crime that carries the death penalty shall be liable to be put to death. Such person shall in addition also be liable to a fine not exceeding ninety thousand penalty units.

Article 6: Penal Servitude

Anyone who has been sentenced to penal servitude shall serve out such sentence on Old Gaol Isle. At the petition of any Jarldom the High King in the High Council of the Realm may, by Order, provide that convicted residents of such Jarldom may serve their sentences in their home Jarldom.

Article 7: Execution of Death Penalty

(a) Every death sentence that is to be executed shall be carried out by beheading and an Althingi Jarl who took part in the judicial deliberations which led to the conviction of the condemned individual shall personally swing the blade, using his Valtian steel sword, provided always that the Jarl of Gularike may use his greatsword Lightning. Death sentences shall be carried out in private at ancient traditional sites such as moot hills, islets, or crossroads.

(B) The previous subarticle notwithstanding, the Althingi Jarl mentioned in that subarticle may, in accordance with venerable tradition and ancient custom, in some cases delegate the duty to carry out a sentence of death which has been handed down or confirmed by the Law Courts of the Lands of the Longships Throne under the Law of the Land to any willing and able person who is listed in the Line of Succession to a Jarlish Throne within the House of the High Realm of such Althingi Jarl.

Article 8: Penalty Units
For the purposes of this Act, a penalty unit shall be the amount of money used to compute pecuniary penalties for crimes. Fines shall be calculated by multiplying the value of one penalty unit by the number of penalty units prescribed for the crime. The value of one penalty unit shall be one hundred Ríkskróna.

Article 9: Forfeiture
The Court, in imposing sentence on a person convicted of a crime, shall order that the person forfeit to the High Realm any property, real or personal, involved in such crime, or any property traceable to such crime. It shall also order that the person forfeit to the High Realm any monetary assets or property constituting, or derived from, proceeds the person obtained directly or indirectly, as the result of such crime. The issuance of a forfeiture order by the Court under this Article shall be mandatory.

Article 10: Weregild

For the purposes of this Act, Weregild shall be the mandatory restitution of the full amount of the victim’s losses by the convict as determined by the Court in addition to any other civil or criminal penalty authorized by Althingi Law. The issuance of a restitution order by the Court under this Article shall be mandatory.

Article 11: Full Amount of the Victim’s Losses

For purposes of determining Weregild under this Act, the term "full amount of the victim’s losses" shall include any costs incurred by the victim of the crime for:

• medical services relating to physical, psychiatric, or psychological care;

• physical and occupational therapy or rehabilitation;

• necessary transportation, temporary housing, and child care expenses;

• lost income;

• damage to property;

• loss of property;

• attorneys’ fees, as well as other costs incurred; and

• any other losses suffered by the victim as a proximate result of the crime.

 

Article 12: The Victim

For the purposes of this Act, the term "victim" shall mean the individual harmed as a result of a commission of a crime under the Law of the Land, including, in the case of a victim who is under 13 years of age, incompetent, incapacitated, or deceased, the legal guardian of the victim or representative of the victim’s estate, another family or household member, or any other person appointed as suitable by the Court, but in no event shall the convict be named as such representative or guardian.

Article 13: Short Title and Commencement

This Act may be cited as the Act on the Punishments for Crime of Year 13 and shall come into operation immediately after it has received the Imperial Assent.

 

In consequence of Us looking with favour upon the decision of the Althing of that Day of the Ladies Divine Frigga, Freyja and Idunn, Fulltrui and Sacred Queens of Stormark since time immemorial, which is known to Us, Our Well-Beloved Royals, Nobles, Knights and Thegns, and all Our other Well-Beloved Patricians and Citizens whatsoever as the Seventeenth Day of the Month Sessrumnir in Folkvanger in the Thirteenth Year of the Second Viking Age in the Second Epoch of Our High Realm that the Law Speaker of the said Althing has most graciously laid before Us, We have assented to and confirmed, as We hereby do assent to and do confirm the same as Law under Our Hand and the Great Seal of Our High Realm.

Given at the Court of the Three Ladies Divine, since time immemorial situated at the Vanadísarhall on the holy island in the sacred river Fulltrui Flow known as Hnossa Isle which is seated within the bounds of the Imperial City of Haraldsborg in Our Jarldom of Gularike, on this Day of the Ladies Divine Frigga, Freyja and Idunn, Fulltrui and Sacred Queens of Stormark since time immemorial, the Seventeenth Day of the Month Sessrumnir in Folkvanger in the Thirteenth Year of the Second Viking Age in the Second Epoch of Our High Realm.
