Royal Decree #1

 

To all Royals, Nobles and Knights and to all other persons whatsoever to whom these Presents shall Come, Greetings:

 

LET IT BE KNOWN that I, Dame Birla Mortensdottir, by the Grace and Generosity of His Imperial Majesty, The Sovereign Viking Emperor, Vicereine and Commandress in Chief of Treisenberg-Ságolann, do hereby ratify the Treaty of Epithrainoi, the Articles being:

 

 

TREATY OF EPITHRANOI

 

BETWEEN

 

THE KINGDOM OF TREISENBERG-SÁGOLANN

 

AND

 

THE VIKING EMPIRE OF STORMARK

 

To all Royals, Nobles and Knights and to all other persons whatsoever to whom these Presents may concern, We, the Heads of Government of the Kingdom of Treisenberg-Ságolann, in the person of Her Most Excellent Highness the Vicereine, and the Viking Empire of Stormark, in the person of His Imperial Majesty the Sovereign Viking Emperor; do extend Our Greetings.

 

WHEREAS there is a desire to solidify the contemporary relations between the Kingdom of Treisenberg-Ságolann and the Sovereign Viking Empire into a state of stability, growth and integration;

 

LET IT THEREFORE BE KNOWN that the following Articles of Agreement have been negotiated in good faith and without effort of evasion or duress by the Governments of the Kingdom of Treisenberg-Ságolann and the Viking Empire of Stormark:

 

Article 1.

 

Treisenberg-Ságolann is a Kingdom within the Viking Empire of Stormark.

 

Article 2.

 

The Instrument of Government of Treisenberg-Ságolann is Supreme Law of the Kingdom of Treisenberg-Ságolann.

 

Article 3.

 

Upon passage of this Treaty all former Treaties between Treisenberg and Stormark, and between Treisenberg-Ságolann and Stormark are repealed.

 

Article 4.

 

This Treaty may only be changed by agreement from both parties to the Treaty.

 

Article 5.

 

This Treaty shall come into operation when it has been passed by the appropriate organs of Government in both Treisenberg-Ságolann and Stormark.

 

Article 6.

 

This Treaty may be cited as the Treaty of Epithranoi.

 

Given under Our respective Signs-Manual, on this the Twenty Second Day of September, 2005.

 

For the Kingdom of Treisenberg-Ságolann:

 

Dame Birla Mortensdottir.

 

For the Viking Empire of Stormark:

 

Harald Torsten I den Givmilde, genom Vikingalagarnas Nåd Enväldig Vikingakejsare av Vikingakejsardömet Stormark, och genom andra Höga Lagars Nåd Kung av Sina andra Riken och Kolonier.

 

 

Given at the High Palace in Treisen, in the Name and on Behalf of His Imperial Majesty, The Sovereign Viking Emperor, Lord Sovereign of the Kingdom of Treisenberg-Ságolann, under My Hand and the Great Seal of the Kingdom of Treisenberg-Ságolann, on the Twenty Third Day of September in the Fourth Year of the Second Viking Age.

To all Royals, Nobles and Knights and to all other persons whatsoever to whom these Presents shall Come, Greetings:

 

LET IT BE KNOWN that I, Dame Birla Mortensdottir, by the Grace and Generosity of His Imperial Majesty, The Sovereign Viking Emperor, Vicereine and Commandress in Chief of Treisenberg-Ságolann, do hereby decree that:

 

I. All legislation currently in force in Treisenberg-Ságolann, except for the Instrument of Government of Treisenberg-Ságolann and legislation made under the said Instrument of Government of Treisenberg-Ságolann, is hereby repealed.

 

II. All state offices and positions of whatever level of goverment or whatever branch of government that existed in Treisenberg-Ságolann immediatly before the coming into force of this Royal Decree, except for Lord Sovereign of the Kingdom of Treisenberg-Ságolann and the offices mentioned in the Instrument of Government of Treisenberg-Ságolann, are hereby abolished.

 

III. All Titles of Nobility that existed in Treisenberg-Ságolann immediatly before the coming into force of this Royal Decree, except for those Titles of Nobility held by His Imperial Majesty, The Sovereign Viking Emperor, are hereby abolished.

 

IV. This Royal Decree shall come into force immediatly.

 

Given at the High Palace in Treisen, in the Name and on Behalf of His Imperial Majesty, The Sovereign Viking Emperor, Lord Sovereign of the Kingdom of Treisenberg-Ságolann, under My Hand and the Great Seal of the Kingdom of Treisenberg-Ságolann, on the Twenty Sixth Day of September in the Fourth Year of the Second Viking Age.

And in the Name and on Behalf of His Imperial Majesty, The Sovereign Viking Emperor, Lord Sovereign of Treisenberg-Ságolann and His Lawful Heirs and Successors, I do appoint give and grant unto him the said name state, degree, style, dignity, title and honor of Duke of Rangarvalla and by these Presents do dignify, invest and ennoble him by girding him with a sword and putting a cap of honor and a coronet of gold on his head to have and to hold the said name state, degree, style, dignity, title and honor.

 

Willing and by these Presents granting in the Name and on Behalf of His Imperial Majesty, The Sovereign Viking Emperor, Lord Sovereign of Treisenberg-Ságolann and His Lawful Heirs and Successors that he may have, hold and possess a seat, place and voice in the House of Peers, His Lawful Heirs and Successors within Treisenberg-Ságolann amongst the Dukes, And also that he may enjoy and use all the rights, privileges, pre-eminences, immunities and advantages to the degree of a Duke duly and of right belonging which Dukes of Treisenberg-Ságolann have heretofore used and enjoyed or as they do at present use and enjoy.

Royal Decree #4

 

To all Royals, Nobles and Knights and to all other persons whatsoever to whom these Presents shall Come, Greetings:

 

WHEREAS I have received a petition by the Esteemed Gentleman Arnkel the Herald to restore the Titles of Nobility that were bestowed upon him by the then Sovereign Prince Franz Josef of Treisenberg in recognition of his long service to the Treisenberger crown;

 

AND WHEREAS I do recognize Arnkell the Herald's long service to the Treisenberger crown the emotional value of those Titles of Nobility to him;

 

LET IT THEREFORE BE KNOWN that I, Dame Birla Mortensdottir, by the Grace and Generosity of His Imperial Majesty, The Sovereign Viking Emperor, Vicereine and Commandress in Chief of Treisenberg-Ságolann, do hereby decree that:

 

I. The Viscouncty of Rossheim, bestowed upon Arnkel the Herald by the then Sovereign Prince Franz Josef III of Treisenberg by Letters Patent dated the Fifteenth Day of February in the Year of Our Lord the Two Thousand and Fifth, is hereby restored.

 

II. The Dukedom of Slavonia, bestowed upon Arnkel the Herald by the then Sovereign Prince Franz Josef III of Treisenberg by Letters Patent dated the Nineteenth Day of May in the Year of Our Lord the Two Thousand and Fifth, is hereby restored.

 

III. The Dukedom of Rossheim, bestowed upon Arnkel the Herald by the then Sovereign Prince Franz Josef III of Treisenberg by Letters Patent dated the Nineth Day of July in the Year of Our Lord the Two Thousand and Fifth, is hereby restored.

 

IV. This Royal Decree shall come into force immediatly.

II. This Royal Decree shall come into force immediatly.

The Kingdom of Treisenberg-Ságolann shall from this day forth adhere to Order in Council #40 issued by His Imperial Majesty, The Sovereign Viking Emperor, on the Twenty Seventh Day of September and shall therefore from this day forth be subject to the jurisdiction of State Committee for Geography and Place Names created by the said Order in Council #40.

 

II. This Royal Decree shall come into force immediatly.

WHEREAS I have received a petition by the Most Illustrious and Most Excellent Law lord Dr. Robert Davis to restore the Title of Nobility that was bestowed upon him by the then Sovereign Prince Franz Josef of Treisenberg in recognition of his service to the Treisenberger crown;

 

AND WHEREAS I do recognize Dr. Robert Davis' service to the Treisenberger crown and the emotional value of that Title of Nobility to him;

 

LET IT THEREFORE BE KNOWN that We, Birla Mortensdottir, Elentári of Treisenberg-Ságolann, do hereby decree that:

 

I. The Dukedom of Howitzstadt, bestowed upon Dr. Robert Davis by the then Sovereign Prince Franz Josef III of Treisenberg by Letters Patent in the Year of Our Lord the Two Thousand and Fifth, is hereby restored.

 

II. This Royal Decree shall come into force immediatly.

I. Upon the coming into force of this Royal Decree the map contained in the Schedule to this Royal Decree shall become and be the Official Map of Treisenberg.

 

II. Upon the coming into force of this Royal Decree all cities, towns and subdivisions in Treisenberg shall, by operation of this Royal Decree, be renamed in accordance with the Official Map of Treisenberg.

 

III. Royal Decree #9 is hereby repealed.

 

IV. This Royal Decree shall come into force immediatly.

Royal Decree #15

 

To all Royals, Nobles and Knights and to all other persons whatsoever to whom these Presents shall Come, Greetings:

 

LET IT BE KNOWN that We, Birla Mortensdottir, Elentári of Treisenberg, do hereby enact the following as Law:

 

AN ACT ESTABLISHING A UNIFORM CRIMINAL CODE FOR TREISENBERG

 

WHEREAS in accordance with the Autonomous Countries’ Code of Stormark the State of Treisenberg is given the right to establish, form and develop codes of law.

 

AND WHEREAS there is a need in having a Criminal Code of Law that meets the particular demands and interests of Treisenberg, so that the Law of the Lands can come nearer the citizens.

 

BE IT THEREFORE ENACTED BY HER IMPERIAL HIGHNESS, BY AND WITH THE ADVICE AND CONSENT OF HER SUBJECTS IN A CONCLAVE OF EQUALS ASSEMBLED, AS FOLLOWS: –

 

Chapter 1

Crimes against the State

 

1. Treason

A person who, being a citizen or resident of Treisenberg:

 

a) does anything tending to the death or destruction of Her Imperial Highness;

 

b ) levies war, or does any act preparatory to levy war, against Her Imperial Highness or the State;

 

c ) assists by any means whatever, with intent to assist, an enemy at war with the State, whether or not the state of public emergency has been declared;

 

d) assists to another person who is, to his knowledge, guilty of treason in order to enable him to escape punishment; or

 

e) knowing that a person intends to commit treason, does not give information thereof to a court or to the Attorney-General;

 

shall be guilty of a crime, called treason, and liable to the punishment of permanent banishment from the territory of the State.

 

2. Treachery

A person who shall do any act or thing to overthrow the Constitution of the State by revolution or sabotage or to overthrow by force or violence the duly established government of the State, shall be guilty of a crime, called treachery, and liable to the punishment of permanent banishment from the territory of the State.

 

3. Sabotage

A person who shall do any act or thing to overthrow the Constitution of the State by revolution or sabotage or to overthrow by force or violence the duly established government of the State shall be guilty of a crime called treachery, and liable to the punishment of permanent banishment from the territory of the State.

 

4. Subversion of Her Imperial Highness’s Government

Any person who, with the intention of causing violence or creating public disorder or public disturbance, says, writes, prints, utters or publishes any words:

 

a) to bring Her Imperial Highness, the Ilquen Farnë, the Mahaxanar, the Arandur or any court of law into contempt;

 

b ) to excite disaffection against Her Imperial Highness’s government;

 

c ) to excite the citizens of the State to attempt to procure the alteration, otherwise than by lawful means, of any matter established by law of the State;

 

d) to promote feelings of ill-will between different groups of the citizens of the State so as to endanger the peace, order and good government of the State; or

 

e) counsels or advices any person to commit any of the aforesaid acts;

 

shall be guilty of a crime, called subversion of Her Imperial Highness’s government, and liable to the punishment of banishment from the territory of the State period fixed by the court.

 

5. Espionage

Any person who, with intent prejudicial to the safety or defence of the State:

 

a) makes within the territory of the State, a sketch, plan or photograph of a place or thing, or a note or document of a thing, that is likely to be, might be or is intended to be directly or indirectly useful to an enemy or a foreign nation;

 

b ) obtains, collects, records, uses, has in possession or communicates to another person any information, including an opinion or a report of a conversation, that is likely to be, might be or is intended to be useful to an enemy or a foreign nation; or

 

c ) approaches, is in, enters, inspects or passes over a place prohibited by an Act;

 

shall be guilty of a crime, called espionage, and liable to permanent banishment from the territory of the State, or for a period fixed by the court.

 

Chapter 2

Crimes against Peaceful Relations with Foreign Nations

 

1. Aggression against a Foreign Nation

A person who, being a citizen of the State, or being lawfully present in the State, without order or approval of Her Imperial Highness, levies war, or does any act preparatory to levy war, against a foreign nation, shall be guilty of a crime, called aggression against a foreign nation, and liable to the punishment of suspension of civil rights for a period fixed by the court.

 

2. Espionage in Prejudice of a Foreign Nation

A person who, being a citizen of the State or being lawfully present in the State, commits, in favour of a foreign nation and in prejudice of another foreign nation any of the acts defined in the Chapter 2(1), shall be guilty of a crime, called espionage in prejudice of a foreign nation, and liable to the punishment of suspension of civil rights for a period fixed by the court.

 

3. Contempt of a Foreign Ruler

A person who, being a citizen of the State or being lawfully present in the State, says, writes, prints, utters or publishes any words to bring a head of a foreign nation (other than an enemy foreign nation) into contempt shall be guilty of a crime, called contempt of a foreign ruler, and liable to the punishment of banishment for a period fixed by the court.

 

Chapter 3

Crimes against Different Persons

 

1. Homicide

A person who, unless it is approved by an Act, does any act, or attempts to do any act, to cause the death or destruction of another natural person, shall be guilty of a crime, called homicide, and liable to the punishment of permanent expulsion from the territory of the State.

 

2. Using Another's Name

A person who, without the consent of another person, uses the name of such person, shall be guilty of a crime, called using another’s name, and liable to the punishment of banishment from the territory of the State for a period fixed by the court.

 

3. Using False Identity

A person who, in order to cause a mistake of another person, uses a name, or declares to have a character, that is not his own, shall be guilty of a crime, called using false identity, and liable to the punishment of banishment from the territory of the State for a period fixed by the court.

 

4. Theft

A person who takes into his possession any thing of any kind, including money, that belongs to another person, unless such an act is made in execution of a law or a contract, shall be guilty of a crime, called theft, and liable to the punishment of banishment from the territory of the State for a period fixed by the court.

 

5. Fraud

A person who commits the act defined in the precedent section in taking a thing that is entrusted to him by another person shall be guilty of a crime, called fraud, and liable to the punishment of banishment from the territory of the State for a period fixed by the court.

 

Chapter 4

Conspiracy

 

If two or more persons agree to commit any crime defined in this Act, but the intended crime shall not be committed, each of these persons shall be guilty of a crime, called conspiracy, and liable to the same punishment that is prescribed by this Act for the crime they have agreed to commit.

 

Chapter 5

Final provisions

 

1. On the definition of “foreign”

For the purposes of this Act, the term “foreign” is included to mean anything to do with Stormark or autonomous countries of Stormark.

 

2. Citation

This act may be cited as the “Criminal Code Act of 2005”

 

3. Force

This act enters force after receiving Imperial Assent from Her Imperial Highness’s hand.

THE CONSTITUTION OF THE ETERNAL REALM OF TREISENBERG

 

 

To all Royals, Nobles and Knights and to all other persons whatsoever to whom these Presents shall come, Greetings:

 

LET IT BE KNOWN that We, Dame Birla Mortensdottir, Elentári of Treisenberg, do hereby grant this Constitution in order that We may establish the mechanisms of good and free government for this Realm.

 

ARTICLE I: GENERAL PROVISIONS

 

1. The name and style of the state shall be the "Eternal Realm of Treisenberg".

 

2. The sovereignty of the state emanates from the people.

 

3. The system of government shall be Constitutional Monarchy.

 

4. The national capital shall be the city of Treisen, which shall be independent of any province or dominion.

 

5. The official language of the state shall be English.

 

6. In all instances, wherein this document makes reference to the masculine pronoun, shall not exclude, the feminine gender, and shall be construed as implying inclusiveness.

 

ARTICLE II. CHARTER OF RIGHTS AND LIBERTIES

 

1. Citizenship shall be granted via the process of naturalization, and shall entitle its holder to the following rights and privileges:

 

a. The right to equality under the law.

b. The right to enjoy and protect life, liberty, and property, and to pursue happiness.

c. The right to speak, print, and otherwise disseminate opinions freely.

d. The right to peacefully assemble.

e. The right to practice, promote, and establish any religion.

f. Freedom from unreasonable search and seizure.

g. The right to a free, public, and speedy trial.

h. The right to legal counsel, provided without cost if the citizen is unable to pay for it.

i. Freedom from forced self-incrimination.

j. The right not to be subsequently tried for an offence of which the citizen has been acquitted, except in the case of a mistrial, or legal misconduct.

k. Freedom from imprisonment for debt.

l. The right to bear arms in self-defence.

m. The security of private property from unlawful seizure.

n. This enumeration of rights and privileges shall not be construed to impair or deny others retained by the people.

 

2. The Monarch or his Ministers may maintain a list of all citizens.

 

ARTICLE III: THE CROWN OF TREISENBERG

 

1. The Crown shall be personified through the person of the Monarch, the King, or in the case of a female holder of the Throne, the Queen as Head of State. The Monarch, as Head of State, is the symbol of the unity and permanence of the State. The Monarch shall also serve as the Pope of the United Church of Stormark, and rule as its head accordingly.

 

2. Upon the coming into operation of this Constitution Pope Camillus I of the United Church of Stormark shall become and be the Monarch of Treisenberg.

 

3. The person of the Monarch is inviolable and is not subject to responsibility. His ministers are responsible.

 

4. The Monarch shall consult the Royal Council of State before traveling abroad, or brief periods which he must be away from his duties. If the absence is extended beyond two weeks, the Royal Council of State shall perform the duties of the Head of State in that temporary capacity. The Church shall be ruled by the Camerlengo, as set out in Papal Decree.

 

5. The Monarch shall have the power to enact Laws by Royal Decree. A Royal Decree must be published in the public forums within twenty-four hours. A two-thirds vote of the Senate in disapproval shall nullify a Royal Decree.

 

6. The Monarch, through the process of the Royal Assent, may approve or disapprove of an Act of the Senate. Only acts that receive approval through the Royal Assent shall be made into Law. Acts that do not receive the consideration of the Crown within 15 days after being dispatched to the Monarch for his Assent, shall be passed into Law with the Royal Assent being automatically assumed.

 

7. The Monarch shall convoke and dissolve the Senate.

 

8. The Monarch may convoke a referendum on the advice of the Council of State or the Senate.

 

9. The Monarch may declare a state of emergency during which time he may dissolve the Senate and rule by decree should it become clearly apparent that the Senate is no longer able to function, thus endangering the survival of the state. The Monarch shall return the Senate within two weeks of declaring a state of emergency. In the event that the Senate cannot be restored, the Monarch shall rule the land independently until such time as the people manifest an ability to govern themselves.

 

10. The Monarch shall appoint and dismiss members of the government.

 

11. The Monarch exercises supreme command of the forces and instruments of national defense.

 

12. The Monarch accredits ambassadors and other diplomatic representatives. Foreign representatives in Nidaros are accredited before him.

 

13. It is incumbent upon the Monarch to express the consent of the State to obligate itself internationally through treaties in conformity with the Constitution and the laws.

 

14. The Monarch may execute Royal Warrants, and Letters Patent to associations and corporate bodies within the Realm.

 

15. The Monarch, as the fons honorum, has sole power to elevate citizens to the nobility, grant and bestow orders of chivalry, and present honours.

 

16. The Monarch may declare national holidays of a temporary or of a fixed permanent nature by proclamation.

 

17. The Monarch may create and dissolve any department of the government.

 

18. The Monarch, upon his coronation, investiture, or enthronement, will swear to faithfully carry out his functions, to obey the Constitution and the laws and ensure that they are obeyed.

 

ARTICLE IV: SUCCESSION

 

1. The Monarch shall be succeeded in the manner as described by the procedure of election of the Pope of the United Church of Stormark. Election shall be limited to the Episcopal College, as stated in procedure.

 

2. If the Monarch has been continuously prevented for a period of two months from carrying out his duties, or has failed to carry them out, the Government shall notify the matter to the Curia. The Curia shall resolve whether the Monarch shall be deemed to have abdicated. In the interim period, commencing with the Government notification to the Curia, the procedure outline in Section 1, shall be implemented.

 

ARTICLE V: REGENCY

 

1. In the event of the Monarch's declared incapacitation, the Royal Council of State shall rule the nation, the Camerlengo as head of the Church, for as long as it can be determined that the Monarch lives and wills to remain upon the throne.

 

2. The Royal Council of State, will attempt to contact the Monarch once every two months during his regency. If the Monarch shall respond and indicate his desire to remain on the throne, the regency shall continue. If the Monarch indicates that he does not wish to remain on the throne, the Royal Council of State shall inform the Kingdom. Thereby procedure of Section 1, Article IV shall commence.

 

3. The procedures outlined in Article V, Section 2, Clause A will be implemented should the Royal Council of State, inform the Kingdom that he has fallen completely out of contact with the Monarch.

 

4. If at any point during regency the Monarch shall communicate that he is once again able to resume his functions and duties, the regency shall come to an end.

 

ARTICLE VI: THE ROYAL COUNCIL OF STATE

 

1. The Royal Council of State is the highest consultative and executive organ of the government. Its function is to advise and assist the Monarch in the governing of the Realm.

 

2. The Royal Council of State shall consist of five members chosen to represent a broad spectrum of Treisenberger society. Persons holding national elective office may not sit on the Royal Council of State.

3. The Monarch shall appoint from among the five members a President of the Council to preside over the Royal Council of State.

 

4. The Royal Council of State shall discharge the duties and functions of the Head of State when the Monarch declares that he shall be absent from the nation for a period or two weeks or longer. The Royal Council of State shall assume the duties of the Head of State on the declared date of the Monarch's departure and shall relinquish them immediately upon hearing word of the Monarch's return.

 

5. Should the Monarch not return, the Royal Council of State will continue to act in the capacity of Head of State for a period of no longer than two months, after which the procedure outline in Article IV, Section 2, shall be implemented.

 

ARTICLE VII: THE SENATE

 

1. The Legislative Power shall be vested in a unicameral Senate, and shall sit in continuous session.

 

2. The session of the Senate shall be convoked, and all members seated and sworn in, immediately upon order of the Monarch.

 

3. Immediately after the session of the Senate is convoked, the Monarch shall deliver a speech to the Senate.

 

4. All persons who have been chosen by the Monarch, or approved by the President of the Senate, as empowered by the Monarch, to serve as Senators shall hold a seat in the Senate.

 

5. The Senate shall be moderated by the President of the Senate, who shall be elected by the members.

 

6. The Senate may establish its procedures in the Senate Standing Orders, which shall be enacted by Resolution.

 

7. The Senate may originate any Bill or Resolution.

 

8. If a Bill is approved by the Senate, it shall be presented to the Monarch for Royal Assent. Resolutions do not require Royal Assent.

 

a. If the Monarch grants Royal Assent to the Bill, it shall hold legal force.

 

b. If the Monarch withholds Royal Assent to the Bill, it shall not hold legal force.

 

c. If the Monarch fails to either grant or withhold Royal Assent within two weeks after the Bill is presented to him, it shall hold legal force.

 

ARTICLE VIII. THE JUDICIAL POWER

 

1. The Judicial Power of Treisenberg is vested in the Law Courts of Stormark.

 

2. The Monarch may appoint a Lord Advocate to defend the Government in legal cases brought against it.

 

ARTICLE IX: SUPREMACY OF LAW

 

1. This Constitution, and the subsequent laws of the Eternal Realm of Treisenberg which shall be made in pursuance thereof; and all treaties made, or which shall be made, under the authority of the said Kingdom, shall be the supreme law of the land. Acts of the Senate, and Royal Decrees of the Monarch shall be considered to be on equal in precedents in so much as they do not conflict with this Constitution, in which case, the Constitution shall maintain supremacy. However complete supremacy shall given to the laws and such acts of the Viking Empire of Stormark. All laws and acts of the Eternal Realm of Treisenberg shall be subordinate to the Viking Empire, and any Treisenberger law, act, etc. may be overturned by the government of the Viking Empire of Stormark.

 

ARTICLE X: AMENDMENTS AND COMMENCEMENT

 

1. This Constitution may be amended by a two-thirds majority of the Senate, or Royal Decree unopposed by the Senate.

 

2. This Constitution shall come into operation immediatly.
