The Organic Law of the Viceroyalty of Vinland

WHEREAS Our Viceroyalty of Vinland is without proper governance;

AND WHEREAS the people of the Far Away Land seek to assert their sovereignty over their own internal government;

AND WHEREAS the history of Vinland and the traditions of the Norse people call upon a just and fair order to promote the general good of the people;

LET IT THEREFORE BE KNOWN that We, by this Our Imperial Instrument, in the exercise of Our Most Ancient Prerogative Imperial and Our Capacity of Jarl-at-Large of all Our Jarlless Jarldoms declare, ordain and enact this Organic Law for Our Viceroyalty of Vinland:

Chapter 1: Fundamental Principles

Article 1: The Viceroyalty of Vinland is a Jarldom of the High Realm of Stormark, and is subject to the High Law of the High Realm of Stormark, its laws, and its authority.

Article 2: All powers of government and all authority in Vinland are derived from the people of Vinland, and the same shall be exercised in the Viceroyalty through the organizations established by or under, and in accord with, this Organic Law.

Article 3: The Viceroyalty of Vinland affirms the rights and liberties of its citizens as defined by the High Law of the High Realm of Stormark.

Article 4: The official language of the Viceroyalty of Vinland is the Norse language, but the English language shall be equally recognized as an official language.

Article 5: The motto of the Viceroyalty shall be, "In freedom, there is strength,” or in Norse, “Í frelsi er styrkur.”

Article 6: The Viceroyalty of Vinland shall be governed by three branches: the executive, legislative, and judicial branches.

Article 7: All powers not conferred upon the High King, the High Council of the Realm, the Althing or other bodies defined in the High Law of the High Realm shall be reserved to the government of the Viceroyalty of Vinland.

Chapter 2: The Executive Branch

Article 1: The executive power of Vinland shall be exercised by the Jarl of Vinland and the Executive Council of Vinland (or Vinlands Landsstýri in the Norse tongue).

Article 2: The Jarl of Vinland shall be appointed by the High King in the High Council of the Realm, shall hold office during the pleasure of His Imperial and Royal Majesty in the High Council of the Realm, and shall serve as the representative of the High King in the High Council of the Realm in Vinland.

Article 3: In the event of a vacancy in the office of Jarl, the Jarl of Gularike shall act as Jarl of Vinland until a successor is appointed.

Article 4: The Jarl shall have such functions as may be prescribed by this Organic Law and any other law, and such other functions as are assigned to him or her by the High Law or other laws.

Article 5: The Jarl shall be responsible for the day-to-day government of the Viceroyalty and for implementing Imperial Law, whether Acts of the Althing, Orders-in-Council, or other Imperial Instruments, in the Viceroyalty.

Article 6: The Jarl may issue Viceroyal Edicts, which shall have the force of law, on matters of legislation which are empowered to the Jarldom by the High Law. Viceroyal Edicts may be overturned by the Vinlandsthing by a two-thirds majority vote.

Article 7: The Jarl shall serve as the Commander-in-Chief of the Vinland Defense Force, and all other public security forces which are not entrusted to the High Realm directly.

Article 8: The Jarl shall grant or withhold assent to all legislation which shall emanate from the Vinlandsthing. A veto by the Jarl may be overturned by a two-thirds majority vote of the Vinlandsthing.

Article 9: The Jarl shall appoint or remove officials and officers of the Viceroyal government, as defined by law, as well as the members of the Executive Council.

Article 10: The Executive Council shall advise the Jarl on matters of policy and legislation within the Viceroyalty, and shall aid in the administration of government within Vinland.

Article 11: The Executive Council shall be collectively responsible for all matters concerning the departments of Viceroyalty administered by members of the Executive Council.

Article 12: The Executive Council shall be composed of the Premier (or Løgmaður in the Norse tounge), and other members as prescribed by law. The leaders of the recognized Native Vinlandish tribes shall serve as ex officio non-voting members of the Executive Council.

Article 13: The members of the Executive Council shall be appointed by the Jarl, but shall be responsible to the Vinlandsthing, and shall serve for the duration of the term of the Vinlandsthing. If the Vinlandsthing shall pass a motion of no confidence in a member of the Executive Council that member shall be forced to resign.

Chapter 3: The Legislative Branch

Article 1: The legislative power of the Viceroyalty of Vinland shall be exercised by the Parliament of Vinland, generally referred to as the Vinlandsthing.

Article 2: The Vinlandsthing shall be composed of 250 Members of Parliament, or Thingmen, elected by the eligible citizenry of Vinland through proportional representation for a term of two years. The Jarl shall be empowered to fill vacancies in the Vinlandsthing for the remaining duration of a legislative term.

Article 3: A general election shall be held within two months after the Jarl has dissolved the Vinlandsthing, or within two months of the expiration of the term of the Vinlandsthing. The Jarl, or an independent commissioner appointed by him or her, shall oversee general elections, and announce the results of an election.

Article 4: Subject to this Organic Law, and the High Law of the High Realm of Stormark, the Vinlandsthing may make laws for the peace, order, and good government of Vinland.

Article 5: All laws must be passed by a simple majority of the members of the Vinlandsthing.

Article 6: The Vinlandsthing shall be presided over by the Speaker (or Law Speaker). The Speaker, or a deputy appointed in the absence of the Speaker, shall be elected by a simple majority vote of the members of the Vinlandsthing for the term of the body.

Article 7: The Vinlandsthing shall have the power to determine its own rules of order and procedure, so long as they do not conflict with the High Law or this Organic Law.

Article 8: Any public official of the Viceroyalty, excepting the Jarl, who is impeached by a two-thirds majority vote, tried, and found guilty by the Vinlandsthing of a serious crime shall be removed from office.

Article 9. The Vinlandsthing shall be allowed to nominate a candidate to the office of Jarl upon its vacancy for consideration by the High King in the High Council of the Realm. The Vinlandsthing shall also be allowed to censure the Jarl, by a two-thirds majority vote, if it is believed that he or she has committed offenses against the people of Vinland. The High King in the High Council of the Realm shall retain the ultimate right to appoint and remove the Jarl of Vinland at his pleasure.

Chapter 4: The Judicial Branch

Article 1: The administration of justice in the Viceroyalty of Vinland shall be entrusted to the Jarl of Vinland, as prescribed in the High Law, and other such courts as shall be laid down by law.

Article 2: Judges of lower courts shall be appointed by the Jarl and shall serve at the pleasure of the Jarl, or resignation, or death, unless impeached and removed by the Vinlandsthing.

Article 3: All judgments of lower courts may be appealed to the Court of First Instance, headed by the Jarl, and may be appealed to the higher courts as defined by the High Law of the High Realm.

Chapter 5: Miscelleneous Provisions

Article 1: All Patricians and Citizens of Stormark resident in Vinland shall be entitled to vote in elections.

Article 2: Any provision of this Organic Law may be amended, whether by way of variation, addition, or repeal, by a two-thirds majority vote of the Vinlandsthing, or a majority vote of the voting citizenry of Vinland.

This Our Imperial Instrument shall come into effect immediately.

Given at the Court of the Three Ladies Divine, since time immemorial situated at the Vanadísarhall in the Imperial City of Haraldsborg in Our Jarldom of Gularike, on this Day of the Lord Thor, the Twenty First Day of the Month Thrymheim in the Eleventh Year of the Second Viking Age in the Second Epoch of Our High Realm.
