The Court of First Instance of the Gulathing is now in session. The Court shall sit as Court of Session. On the agenda is the Hearing concerning the petition filed by Vilhjálm Kormak. Lady Unna of Skálavik, Jarla of the Sólareyjar shall preside over this Hearing.

Your Ladyship,

 

I respectfully refer you to the original petition, in which the background is cited for this petition.

 

Without a proper leader, the house of Farewell will not be able to function. It will not be able to participate in the High Realm and not safeguard its people the rights they have constitutionally.

To summarize the petitioner's points:

 

Whereas the House of Farewell is without effective leadership, whereas only Petitioner has shown interest in leading the house, and whereas method of the house of Farewell for appointing new leaders exist, it is accordingly in the petitioner's belief that he should be appointed head of the House of Farewell.

The Petitioner

On the Sixth Day of the Month Vidiland in the Tenth Year of the Second Viking Age in the Second Epoch of the High Realm a Petition was filed with this Court by Ambassador Vilhjálm Kormak, Advocate, agent and counsel of His Imperial Highness Daniel, Royal Jarl in the Sólareyjar, Jarl of Freyja's Necklace, and abroad, Prince, Thane and Satrap of Hurmu, Emir of Sathrati, Lord of Farewell and Guardian of the Elwynn Heart, Satrap of East Báatharz. The said Petition was registered by this Court as Petition No. 1 of Year 10.

The Respondent

None.

Statement of the Case

In the said Petition His Imperial Highness requested this Court to be recognized as Head of the House of the High Realm known as the House of Farewell.

Jurisdiction

This Court has jurisdiction over this matter under Article I of the Fourth Chapter of the High Law of the High Realm of Stormark.

Evidence

The Court has read, heard and considered the following document, pleadings and oral evidence relevant to a decision on this matter:

The statement of facts in Petition No. 1 of Year 10; and

Vilhjálm Kormak's opening and final statement.

Findings

Having read, heard and considered the evidence this Court finds that the House of the High Realm known as the House of Farewell has been without effective leadership ever since Sir Ragnar Brunnketilsson succeeded to the Patriarchate of the House of Farewell due to his continued neglect of his duties as Head of the said House of the High Realm which has left the said the House of Farewell in limbo.

Under Article VII of the Seventh Chapter of the High Law of the High Realm of Stormark Houses of the High Realm may internally organize themselves as they see fit. The House of Farewell has, however, no provisions to address the issue of inactive leadership making it impossible for the said House of the High Realm deal with the matter of Sir Ragnar Brunnketilsson's inactivity.

It is well-settled Udal Law in the High Realm of Stormark that in the event that a legal matter arises which cannot be dealt with due to legal deficiencies the Law Courts may intervene. This Court duly recognizes that such a matter has arisen concerning the leadership of the House of Farewell and therefore deems that Sir Ragnar Brunnketilsson has vacated the Patriarchate of the House of Farewell.

This Court has also established that His Imperial Highness Daniel has, due to being the founder of the House of Farewell as well as a lack of other members of the said House of the High Realm, the strongest legitimate claim to the Patriarchate of the House of Farewell.


For the foregoing reasons,

It is ordered by this Court that the Petition was filed with this Court by Ambassador Vilhjálm Kormak, Advocate, agent and counsel of His Imperial Highness Daniel, Royal Jarl in the Sólareyjar, Jarl of Freyja's Necklace, and abroad, Prince, Thane and Satrap of Hurmu, Emir of Sathrati, Lord of Farewell and Guardian of the Elwynn Heart, Satrap of East Báatharz on the Sixth Day of the Month Vidiland in the Tenth Year of the Second Viking Age in the Second Epoch of the High Realm known as Petition No. 1 of Year 10 is granted.

Given at the Old Hall of Justice this 24th day of Vidiland, in the Tenth Year of the Second Viking Age.
