Citizenship Charter

Beloved Citizens,

 

The current set of Rules governing Citizenship in this Most Sovereign and Noble Viking Empire is obsolete. I would therefore like to enact new Rules concerning Citizenship in this Most Sovereign and Noble Viking Empire so please submit your thoughts, ideas and opinions on this matter.

In this matter there is only black and white. Being a citizen implies rights and duties. No one should have more rights than any other, though every citizen should be encouraged to accept as many duties as possible.

 

Temporary citizens are just tourists. They come for leisure. They take more than they give. They are exploited by handy merchants. (maybe they give more than they think)

 

The title of honorary citizen is given to express respect. It should encourage the 'victim' to share his experience. The title gives little rights but implies duties.

 

A citizens' child should be a citizen by right.

 

These rules are not really outdated. Some 'refreshment' however is in order.

What about codifying current and new Citizenship rules and practices into a new High Law of Stormark?

Also put immigration and clan provisions into it and then call it Law of the Weal. smile.gif

AN ACT TO CREATE A HIGH LAW OF THIS MOST SOVEREIGN AND NOBLE VIKING EMPIRE CONCERNING IMMIGRATION, NATUARALZATION AND CLANS.

 

 

Article I.

(1) Upon the coming into operation of this Act anyone who was a Citizen of this Most Sovereign and Noble Viking Empire immediately before the coming into operation of this Act shall remain a Citizen of this Most Sovereign and Noble Viking Empire. The future acquisition and loss of Stormarkian Citizenship shall be determined in accordance with this Act.

 

(2) No Citizen of Stormark may hold Citizenship in or Allegiance to any other micronation than this Most Sovereign and Noble Viking Empire. The aforementioned provision shall not apply to any person who was a Citizen immediately before the coming into operation of this Act.

 

(3) Citizenship in Autonomous Countries or Protectorates of Stormark shall, for the purposes of this Act, be regarded as holding in this Most Sovereign and Noble Viking Empire.

 

(4) The Emperor in the Council of State may, by Order, provide that the prohibition laid down in subarticle 2 shall not apply to holding Citizenship in certain Ancient Friends that always have faithful.

 

Article II.

(1) There shall continue to be four kinds of Stormarkian Citizenship:

 

(a) Full Citizenship;

 

(B) Ettlingar Freyu Citizenship;

 

(c ) Honourary Citizenship; and

 

(d) Autonomous Country Citizenship.

 

(2) The Emperor in the Council of State shall have the sole and exclusive power to, by Order, grant Full Stormarkian Citizenship.

 

(3) The Emperor shall continue have the sole and exclusive power to grant Honourary Citizenship upon whomever He pleases.

 

(4) Ettlingar Freyu Citizenship shall only be acquired in the event that a person becomes a Member of the House of Ettlingar Freyu.

 

(5) The acquisition of Autonomous Country Citizenship shall be governed by the specific provisions of that High Law of this Most Sovereign and Noble Viking Empire known as the Law on Administrative Subdivisions.

 

Article III.

(1) The Emperor in the Council of State shall have the sole and exclusive power to, for any reason which to Him seem sufficient, revoke Full Stormarkian Citizenship.

 

(2) The Emperor shall continue have the sole and exclusive power to revoke Honourary Citizenship as well as Ettlingar Freyu Citizenship whenever He pleases.

 

(3) The loss of Autonomous Country Citizenship shall be governed by the specific provisions of that High Law of this Most Sovereign and Noble Viking Empire known as the Law on Administrative Subdivisions.

 

(4) Notwithstanding subarticle 1, the power to deprive a Citizen of Stormark of his or her Citizenship may by Statute also be vested in the Law Courts of Stormark or any other tribunal lawfully exercising criminal jurisdiction.

 

Article IV.

Bearing true faith and allegiance to the Emperor, and defending, protecting and supporting Him against all enemies both foreign as domestic are fundamental political duties of all Citizens of Stormark.

 

Article V.

(1) Any person having reached or passed the age of thirteen who wishes to become a Citizen of Stormark may petition the Imperial Government of this Most Sovereign and Noble Viking Empire for Full Stormarkian Citizenship.

 

(2) Any such person petitioning for Full Stormarkian Citizenship shall be directed to the Hall of Frigga. The Member of the Council of State entrusted with immigration matters shall act on every request for Stormarkian Citizenship filed with the Hall of Frigga.

 

Article VI.

(1) The Member of the Council of State entrusted with immigration matters shall ascertain to his own satisfaction, through correspondence or conversation, that the prospective immigrant is a real human being with genuine interest in becoming a Citizen of this Most Sovereign and Noble Viking Empire and has a good understanding of the ways of this Most Sovereign and Noble Viking Empire, in particular its traditions, its culture, and its laws.

 

(2) The Member of the Council of State entrusted with immigration matters shall be free to inquire the petitioner on any and all subject, and shall be required to collect the name, telephone number, and e-mail address(es) of the candidate as well as the Viking Name the (s)he shall use in Stormark, during and after the succesful completion of the immigration process, as required by ancient tradition.

 

(3) The Member of the Council of State entrusted with immigration matters shall also be required to collect an essay, written by the petitioner, entitled 'Hear My Plea, Request for Citizenship'. The said essay shall contain the reason why the said petitioner is interested in becoming a Citizen of Stormark.

 

(4) The Member of the Council of State entrusted with immigration matters shall communicate the collected information to the Emperor.

 

Article VII.

(1) After having collected the required information the Member of the Council of State entrusted with immigration matters shall open a single thread on the forums of this Most Sovereign and Noble Viking Empire offically introducing the prospective immigrant to this Viking Nation. The 'Hear My Plea, Request for Citizenship' Essay shall also be posted by the Member of the Council of State entrusted with immigration matters in the said introduction thread.

 

(2) The Member of the Council of State entrusted with immigration matters shall remind his fellow Citizens from time to time that the initiation of new Citizens into this Most Sovereign and Noble Viking Empire is a serious matter and that questioning a prospective Citizen is a patriotic obligation of all who love their Emperor and Country.

 

Article VIII.

(1) An examination period shall begin with the prospective Citizen’s first posting to the forums of this Most Sovereign and Noble Viking Empire after his offficial introduction to this Viking Nation by the Member of the Council of State entrusted with immigration matters.

 

(2) Any current Citizen of this Most Sovereign and Noble Viking Empire may, at any time no less than fifteen days after the beginning of the examination period, petition the Emperor in the Council of State requesting that an Order granting the prospective citizen Full Stormarkian Citizenship be issued. Such petition shall be filed in the Emperor's Private Cabinet.

 

(3) As soon as may be after the filing of a petition under subarticle 2, the Member of the Council of State entrusted with immigration matters shall make a recommendation to the Emperor in the Council of State based upon the person's character and understanding of the ways of this Most Sovereign and Noble Viking Empire in particular its traditions, its culture, and its laws.

 

(4) In the event that no petition under subarticle 2 is laid before the Emperor in the Council of State within the first forty days of the examination period, the examination period shall end, the immigration process for the prospective Citizen shall, by operation of this Act, be terminated and the Member of the Council of State entrusted with immigration matters shall inform the prospective Citizen of the termination of the said immigration process, and shall post a notification to that effect in the Hall of Frigga.

 

Article IX.

(1) Any biological or adoptive child of a Citizen of Stormark who is under the age of thirteen at the time that either of his or her parents acquires Stormarkian Citizenship shall be a Citizen of this Most Sovereign and Noble Viking Empire through the Citizenship of the said parent. Such children shall be known as Landesbarn.

 

(2) Landesbarn shall automatically have the all the rights and privileges of a Citizen of Stormark when they notify their official entry into this Most Sovereign and Noble Viking Empire's society to the Hall of Frigga on or after their thirteenth birthday. Notification shall consist of writing a ‘What Stormark Means to Me’ Essay.

 

Article X.

(1) Any Citizen of this Most Sovereign and Noble Viking Empire may renounce his or her Citizenship by issuing a written Declaration of Renunciation in the Hall of Frigga.

 

(2) Once renounced or revoked, Citizenship may be restored only at the pleasure of the Emperor in the Council of State, which may be difficult to obtain, depending upon the circumstances of such renunciation or revocation.

 

(3) Any person petitioning the Emperor in the Council of State for a restoration of his Citizenship shall include in his or her Petition for Restoration of Citizenship a 'Why Stormark Hasn't Meant That Much To Me' Essay, explaining the reasons why (s)he renounced his or her Citizenship, and indicating how (s)he intends to participate in this Most Sovereign and Noble Viking Empire in future.

 

(4) The Emperor in the Council of State shall review the Petition for Restoration of Citizenship and may, by Order, restore the said person's Citizenship.

 

Article XI.

 

(1) Where it appears to the Emperor that there are reasonable grounds for believing that deportation from this Most Sovereign and Noble Viking Empire of any person who is not a Citizen of Stormark is conducive to the good of this Most Sovereign and Noble Viking Empire, the Emperor may issue a warrant for the arrest and detention of that person.

 

(2) As soon as possible, the Emperor in the Council of State shall deliberate on the question whether a person arrested and detained under this Act should be deported from this Most Sovereign and Noble Viking Empire.

 

(3) A person arrested and detained under this Act may be held until such time the Emperor in the Council of State has decided upon the fate of the said arrested and detained person provided always that such decision shall be rendered within fourteen (14) days after the issuance of the warrant for the arrest and detention of such person.

 

(4) Should the Emperor in the Council of State fail decide upon the fate of any person arrested and detained under this Act within the term specified in subarticle 3 the said person shall be released immediately.

 

(5) Should the Emperor in the Council of State decide not to deport a person arrested and detained under this Act the said person shall be released immediatly.

 

(6) Should the Emperor in the Council of State decide, within the term specified in subarticle 3, to issue a deportation order for a person arrested and detained under this Act the said person may be held until such time as such deportation order is executed.

 

(7) The Imperial Instrument known as Imperial Decree #121 shall, upon the coming into operation of this Act, become and be an integral part of this Act provided always that the powers granted to the Emperor by the said Imperial Instrument shall, upon the coming into operation of this Act, belong to the Emperor in the Council of State.

A couple of suggestions:

 

Leave the Clans out of this Act for the system of Clans is till underdeveloped;

 

Put in a provision concerning Stormakian Elders.

AN ACT TO CREATE A HIGH LAW OF THIS MOST SOVEREIGN AND NOBLE VIKING EMPIRE TO MAKE FRESH PROVISION CONCERNING IMMIGRATION AND NATURALIZATION.

 

Article I.

(1) Upon the coming into operation of this Act anyone who was a Citizen of this Most Sovereign and Noble Viking Empire immediately before the coming into operation of this Act shall remain a Citizen of this Most Sovereign and Noble Viking Empire. The future acquisition and loss of Stormarkian Citizenship shall be determined in accordance with this Act.

 

(2) No Citizen of Stormark may hold Citizenship in or Allegiance to any other micronation than this Most Sovereign and Noble Viking Empire. The aforementioned provision shall not apply to any person who was a Citizen of Stormark immediately before the coming into operation of this Act. The said provision shall also not apply to Honourary Citizens.

 

(3) Holding Citizenship in Autonomous Countries or Protectorates of this Most Sovereign and Noble Viking Empire shall, for the purposes of this Act, be regarded as holding Citizenship in this Most Sovereign and Noble Viking Empire.

 

(4) The Emperor in the Council of State may, by Order, provide that the prohibition laid down in subarticle 2 shall not apply to holding Citizenship in or Allegiance to certain Ancient Friends that always have faithful provided always that He may also, by Order, set a limit to the number of Citizenships in and Allegiances to the said Ancient Friends that a Citizen of Stormark may hold.

 

Article II.

(1) There shall continue to be four kinds of Stormarkian Citizenship:

 

(a) Full Citizenship;

 

(B) Ettlingar Freyu Citizenship;

 

(c ) Honourary Citizenship; and

 

(d) Autonomous Country Citizenship.

 

(2) The Emperor in the Council of State shall have the sole and exclusive power to, by Order, grant Full Stormarkian Citizenship.

 

(3) The Emperor shall continue have the sole and exclusive power to grant Honourary Citizenship to whomever He pleases provided always that no more than two persons per Asgard Calendar Year shall be granted Honourary Citizenship.

 

(4) Ettlingar Freyu Citizenship shall only be acquired in the event that a person becomes a Member of the House of Ettlingar Freyu.

 

(5) The acquisition of Autonomous Country Citizenship shall be governed by the specific provisions of that High Law of this Most Sovereign and Noble Viking Empire known as the Law on Administrative Subdivisions.

Revocation of Ettlingar Freyu Citizenship shall be the effect of the termination of a person's Membership in the House of Ettlingar Freyu provided always that any person who ceases to be a Member of the House of Ettlingar Freyu shall become, unless the Emperor provides otherwise, a Full Citizen of Stormark.

 

(3) The loss of Autonomous Country Citizenship shall be governed by the specific provisions of that High Law of this Most Sovereign and Noble Viking Empire known as the Law on Administrative Subdivisions.

 

(4) Notwithstanding subarticle 1, the power to deprive a Citizen of Stormark of his or her Citizenship may by Statute also be vested in the Law Courts of Stormark or any other tribunal lawfully exercising criminal jurisdiction.

(2) Landesbarn shall automatically have the all the rights and privileges of a Citizen of Stormark when they notify their official entry into this Most Sovereign and Noble Viking Empire's society to the Hall of Frigga on or after their thirteenth birthday. Notification shall consist of telling the Viking name by which (s)he would like to be known within this Most Sovereign and Noble Viking Empire and writing a 'What Stormark Means to Me' Essay.

 

Article X.

(1) Upon the coming into operation of this Act anyone who was a Stormarkian Elder immediately before the coming into operation of this Act shall remain a Stormarkian Elder.

 

(2) Future Stormarkian Elders shall be those persons who have completed their tenth consecutive year as a Citizen of this Most Sovereign and Noble Viking Empire.

 

Article XI.

(1) Any Citizen of this Most Sovereign and Noble Viking Empire may renounce his or her Citizenship by issuing a written Declaration of Renunciation in the Hall of Frigga.

 

(2) Once renounced or revoked, Citizenship may be restored only at the pleasure of the Emperor in the Council of State, which may be difficult to obtain, depending upon the circumstances of such renunciation or revocation.

The Emperor may, when executing the said detention order, take any and all measures He may deem necessary to prevent a deported person from returning to this Most Sovereign and Noble Viking Empire.

 

Article XIII.

The Imperial Instrument known as Imperial Decree #121 shall, upon the coming into operation of this Act, become and be an integral part of this Act provided always that the powers granted to the Emperor by the said Imperial Instrument shall, upon the coming into operation of this Act, belong to the Emperor in the Council of State.

 

Article XIV.

The Udal Law concerning Citizenship in this Most Sovereign and Noble Viking Empire shall, upon the coming into operation of this Act, cease to have effect.

 

Article XV.

All written law concerning Citizenship in this Most Sovereign and Noble Viking Empire shall, upon the coming into operation of this Act, be repealed.

 

Article XVI.

This Act may be cited as the Law of the Weal.

 

Article XVII.

This Act shall come into operation immediately after it has received the Imperial Assent.
