Royal Constitution for the Eternal Realm of Dún Gail Dara

 

 

PREAMBLE

 

When every nation, in the course of time, endeavours to protect its valued beliefs, those beliefs are in one form or another enshrined. Bearing this is mind, recognising the supremacy of the gods and of the law, the Royal Constitution for the Eternal Realm of Dún Gail Dara is thus ordained, enacted and established.

 

Part I

Freedoms and Rights of Citizens

 

1. Every citizen of the Eternal Realm of Dún Gail Dara, by birth or naturalisation, regardless of age, gender, race, ethnic origin, religion or disability, have the following fundamental rights within reasonable limits.

 

(a) freedom of conscience and religion;

 

(b ) freedom of thought, belief, opinion, and expression. This includes freedom of the press, and other media of communication;

 

(c ) freedom of peaceful assembly; and

 

(d) freedom of association.

 

2. Every citizen of the Eternal Realm of Dún Gail Dara has the right to remain in, leave, enter and travel through Dún Gail Dara at his or her own discretion. Furthermore, every citizen of the Eternal Realm of Dún Gail Dara has the right to settle in any area of the country where they can obtain

residence.

 

3. Every citizen has the right to security of person and property, and the right to be deprived of these only through the process of justice that is prevalent in a free society.

 

4. No citizen may be searched or have property seized without reasonable grounds as approved by a Law Court of Stormark.

 

5. Every citizen who is arrested has the right to be informed of the charges laid against him or her, and furthermore have the right to be brought to trial on the charge in a reasonable amount of time.

 

6. No citizen shall be convicted of a crime except by the Law Courts of Stormark.

 

7. Every citizen has the right to be considered innocent of a stated charge, until such time as the citizen is proven guilty in the Law Courts of Stormark, and to be treated equally to any other citizen under the law.

 

8. Every citizen has the right to an appropriate sentence, without cruel and unusual punishment, including a method of execution that inflicts minimum suffering and humiliation in cases where such penalty is ordered.

 

Part II

The Government

 

1. Popular legislative power shall, through the Good Grace of the Ard-Ri, be vested in the Oireachtas.

 

2. The Oireachtas shall be composed of all citizens of the Eternal Realm of Dún Gail Dara.

 

3. The Oireachtas shall create legislation for the benefit of the people, and shall act as the people's voice in government. No legislation may be created by the Oireachtas that violates this Royal Constitution or any Royal Decree.

 

4. The Eternal Realm of Dún Gail Dara shall adhere to the High Laws and Statutes of the Viking Empire of Stormark, and the Autonomous Countries' Code in particular.

 

5. Dún Gail Dara is, first and foremost, a Celtic nation. While all are welcomed, the roots of Dún Gail Dara are entwined around the customs and culture of the Celts; Brehon Law shall therefore be a main source for legislation.

 

6. The Taoiseach shall be appointed solely by the Monarch, and shall be in charge of the daily operations of the Eternal Realm of Dún Gail Dara. As executive, he or she may (with the consent of the Monarch) appoint Ministers of the Crown, and create new Crown Ministries.

 

7. Before taking office, all members of the government shall swear/affirm the following oath/declaration: I swear/affirm that I, (name) will be faithful and bear true allegiance to His/Her Most Sacred Majesty (name of current monarch), Ard-Ri of of Dún Gail Dara, His/Her Heirs and Successors, and that I will faithfully observe the laws of Eternal Realm of Dún Gail Dara and fulfil my duties as a member of His/Her Most Sacred Majesty’s government.

 

Part III

The Monarchy

 

1. The Eternal Realm of Dún Gail Dara was founded on the belief that a strong, kind, caring, leader is the basis for any successful society, and as such, the Monarch is, under the Overlordship of His Imperial Majesty, The Sovereign Viking Emperor, Head of State of the Eternal Realm of Dún Gail Dara.

 

2. The word of the Monarch is law. Royal Decrees cannot be overturned, except by the Law Courts of Stormark, and do not need ratification by the Oireachtas.

 

3. The Monarch shall bear the title "His/Her Most Sacred Majesty, Ard-Ri of Dún Gail Dara"

 

4. The Monarch is to be treated with extreme respect, and shall be addressed as "Your Most Sacred Majesty" or "Your Majesty".

 

5. A Tánaiste (successor) shall be appointed by the Monarch before the end of his or her reign. The Tánaiste fills in for the Monarch during a period of extended absence. Subject to those limitations imposed by Royal Decree, the Tánaiste shall be vested with all the executive powers of the Monarch but may not repeal or amend Royal Decrees issued by the Monarch. The Monarch reserves the right to override or amend any actions made by the Tánaiste.

 

6. The Monarch shall be responsible for summoning, overseeing, and dissolving the Oireachtas. Furthermore, the Monarch must approve all bills passed by the Oireachtas in order for the said bills to become law. The right to counsel, encourage, and warn, as well as all residual powers are also vested in the Monarch.

 

Part IV

The Judiciary

 

1. The Judicial Power of the Eternal Realm of Dún Gail Dara is vested in the Law Courts of Stormark.

 

Part V

Amendments

 

1. In order to amend this Royal Constitution, three-fourths (3/4) of the Oireachtas must be in favour of the proposed amendment. No amendments may be made to this Royal Constitution during the absence of the Monarch.

 

This is Our Will, and Our Will is Law.

 

Given at Our Court at Tara Castle this 23rd day of the Month Gort in the First Year of Our Reign.
