Law of Stormark
Act of the Althing

AN ACT TO MAKE PROVISION CONCERNING THE BORDERS OF THE HIGH REALM OF STORMARK; TO PROVIDE FOR THE CONTROL OF THE AFORESAID BORDERS; AND TO PROVIDE FOR MATTERS CONNECTED TO THE AFORESAID.

Most Gracious Sovereign Lord and Ruler of all the Lands Whatsoever Where Man Can Smell the Scent of Saline Waters or Hear the Sound of Crashing Waves,

WHEREAS it seems that unsavoury and illegal activity on the Dark Side of Reikistjarna may be at the brink of an upsurge due to the quite recent emergence of new nauseating gangster groups and rogue states willing to facilitate such maritime robbing scum, causing concern for the security of the borders of the Lands of the Longships Throne;

AND WHEREAS we, Your Imperial and Royal Majesty's Most Faithful Jarls in the Althing assembled, have most solemnly endeavoured to exercise our Supreme Legislative Authority to, for the benefit of Storish Society, address the potential peril aforesaid by making statutory provision to create additional tools and powers for the the Imperial Customs and Border Police and the Imperial Storish Government to provide for the protection and control of the borders of the Twenty-Six Jarldoms in accordance with national government policies at any particular time;

NOW, THEREFORE, we, Your Imperial and Royal Majesty’s most dutiful and loyal Patricians, the Most Honourable Jarls of the High Realm in the Althing assembled, have freely and voluntarily resolved to create and establish this Statute concerning the institution of a regime for the borders of the the Lands of the Longships Throne to known as Merkistjórn by this Act of ours and through the provisions of the Act aforesaid provide for the making of border policies that support national security and public safety priorities and facilitates the free flow of persons and goods, including animals and plants, that meet all requirements under the Law of Stormark as well as provide for the statutory punishment for the violation of the Merkistjórn, and we do most humbly beseech Your Imperial Valtian Viking Majesty that You may be graciously pleased to assent to and confirm as Law the following decision of Your Most Faithful Althingi Jarls:

Article 1: Storish State Border

The borders of the High Realm of Stormark (hereinafter "the state border") shall be uninterrupted and closed imaginary lines and the vertical areas along those lines which delimit the territories and the territorial waters of the High Realm of Stormark, the parts of transboundary water bodies which belong to the Lands of the Longships Throne, and the planet’s crust and airspace.

Article 2: Walled Garden

There shall, in accordance with venerable tradition and ancient custom, be a towering separation wall along the edge of the state border where the border aforesaid runs on land. The wall aforesaid shall be designed to look like a ruined castle wall and be built in harmony with the landscape. Such wall shall be fitted with sufficent gates which shall serve as border crossings.

Article 3: Where No Wall Shall Be Built

The previous Article notwithstanding, no wall shall be constructed where the High Realm shares land borders with a Storish Biland or a friendly country that is safe and stable and also runs no risk of degenerating into a hater country or rogue state. In such cases the state border shall be marked with permanent border markers.

Article 4: Marking of State Border on Water and Ice

The state border shall on transboundary water bodies be marked with floating border markers. In those areas of the Lands of the Longships Throne where waters freeze up in winter as well as in the permanent ice areas, the border aforesaid shall be marked with temporary or permanent, as the case may be, border markers placed on the ice.

Article 5: Border Zone

On land, a border zone shall be a territory which may be up to 100 metres wide, measured from the border line, and which shall run parallel with the state border as well as inwards into the national territory. On a natural border line, a border zone is a strip of land which runs up to the start of and parallel with a straight line connecting bends, in into inland direction, or a border river or stream or road of the territory and which is up to 100 metres wide in the direction of the inland. In cities or other settlements, a border zone shall be established according to necessity.

Article 6: Layout of a Border Zone

The layout of a border zone and the description of its elements on the section of the border on land and on transboundary water bodies may be established by or under the authority of the High King in the High Council of the Realm by a regulation, in accordance with, if any, international agreements entered into. The territory of a border zone shall be the property of the State. Any activity which is not related to the maintenance and monitoring of border markers and of a border zone and border control or crossing of the state border is prohibited on a border zone.

Article 7: Maintenance of State Border

The Imperial Customs and Border Police shall monitor the state of a border zone and border markers, upkeep them and impede unlawful changing of the marking of the state border and border zone. The procedure for the maintenance of border markers and border constructions shall be established by or under the authority of the High King in the High Council of the Realm by a regulation pursuant to international agreements.

Article 8: Police Powers Regarding Border Control

In order to perform border control, the Imperial Customs and Border Police may install signs, signposts, marks and barriers, which facilitate the border control, the border checks and the ensuring of the Merkistjórn and restrict or direct traffic, on the territory of a border crossing point and to the immediate vicinity of the border, coordinating the installation thereof with competent authorities, and on the roads and paths leading to the border and the bank of a transboundary water body, coordinating the installation thereof with the competent authorities, local governments and owners of land.

Article 9: Specifications of Boundary Marks

The shape, constructions, elements and dimensions of the border markers, signs, signposts and other marks as well as the procedure for the installation thereof shall be established by or under the authority of the High King in the High Council of the Realm.

Article 10: Merkistjórn

The Most Honourable Jarls in the Althing assembled hereby decree that from the coming into operation of this Act there shall, just like in the days of ancient Valtia, be a border regime (hereafter "the Merkistjórn") that shall govern all matters concerning the borders of the Lands of the Longships Throne. Any rights, privileges, immunities, advantages, obligations and restrictions arising from the Merkistjórn shall, unless provided for by Althingi Law or an international agreement, be established by or under the authority of the High King in the High Council of the Realm or an agency authorised thereby, unless otherwise provided by Althingi Law.

Article 11: Merkistjórn Duties of the Imperial Customs and Border Police

It shall in the exercise of the Merkistjórn be the duty of the Imperial Customs and Border Police to:

administer legislation that governs the admissibility of people and goods, plants and animals into and out of the Twenty-Six Jarldoms;

removing people who are inadmissible to the High Realm, including those involved in terrorism, organized crime, war crimes or crimes against humanity;

detain those people who may pose a threat to the Twenty-Six Jarldoms;

interdicting illegal goods entering or leaving the High Realm;

seize or impound any vessel, aircraft or vehicle that is in violation of the Laws of the Twenty-Six Jarldoms;

protecting food safety, plant and animal health, and Stormark’s resource base;

promoting Storish business and economic benefits by administering trade legislation and trade agreements to meet the High Realm's international obligations;

enforcing trade remedies that help protect Storish industry from the injurious effects of dumped and subsidized imported goods;

promoting Storish interests in various international forums and with international organizations;

administer a fair and impartial redress mechanism; and

collecting applicable duties, tariffs and taxes on imported goods.

The aforesaid functions shall be performed in an appropriate and objective manner, promoting equal treatment and a conciliatory spirit.

Article 12: Certain Restrictions

The Most Honourable Jarls in the Althing assembled hereby decree that the Merkistjórn may restrict activity which impedes border control or disturbs border peace, such as use of firearms and explosive substances, working in the immediate vicinity of a border zone, hunting and fishing, grazing of cattle, use of lighting and open fire.

Article 13: Liability to Border Checks

All persons, means of transport, goods and other tangible assets shall be subject to border checks upon crossing of the external border or conveyance across the external border. Border checks shall consist of checking of crossing of the state border by persons and means of transport, customs control and, where necessary, security control, sanitary, veterinary or plant health control and other types of control established by international agreements and by or under Althingi Law.

Article 14: Passports

A foreigner arriving in the Twenty-Six Jarldoms shall, unless a different arrangement is provided by or under the authority of the High King in the High Council of the Realm, possess a passport or other identity document recognised as a travel document.

Article 15: Border Checks

In border checks, upon checking of crossing of the state border, the Imperial Customs and Border Police shall check persons and establish whether a person may be granted authorisation to cross the state border. Checking of persons shall include checking of a person’s documents, bases for stay, baggage and means of transport.

Article 16: Law Enforcement Powers

In the performance of their law enforcement duties under this Act the Imperial Customs and Border Police shall have power to conduct border checks, inquiries, surveillances, interceptions, examinations, inspections, interdictions, searches, seizures, and arrests to prevent, detect, and suppress violations of the Law of Stormark.

Article 17: Merkistjórn Procedures

The Most Honourable Jarls in the Althing assembled hereby decree that the Merkistjórn, subject to this and any other Act, shall specify the procedure for:

the crossing of the state border by persons and means of transport;

the conveyance of goods (property, including things, currency and securities, and also animals) across the state border;

floating vessels (hereinafter vessels) to enter, navigate and stay on and exit the territorial sea and inland maritime waters as well as Storish waters of transboundary water bodies;

aircraft to enter the Storish airspace, move in the aforementioned airspace and exit the Storish airspace;

persons and means of transport to enter, be at and exit a border crossing point, and for goods to be brought to, be at and be removed from a border crossing point.

Article 18: Powers to Permit or Deny Entry

In the exercise of the Merkistjórn the High King in the High Council of the Realm shall have power to:

permit or deny departure and landing rights of foreign carriers within the Twenty-Six Jarldoms;

permit or deny foreign vessels to dock at any port within the Lands of the Longships Throne;

permit or deny to any outlander or class of outlanders entry into the Twenty-Six Jarldoms;

seal the state border of the High Realm of Stormark or any part thereof;

close the airspace of the Lands of the Longships Throne or any part thereof.

Article 19: Emergency Powers

In the event that a threat to public order, national security or public health requires immediate action, the High Justiciar of Stormark or the Warden of the Inland shall decide upon any necessary measures pending a decision of the High King in the High Council of the Realm.

Article 20: Crossing of State Border

Persons and means of transport arriving in or departing from the High Realm may cross the state border and goods to be brought into the Twenty-Six Jarldoms or goods to be exported out of the Lands of the Longships Throne may be conveyed across the state border only through border crossing points open for international traffic during the operating hours thereof.

Article 21: Authorisation for Crossing

Authorisation for crossing of the external border shall be granted by a police officer of the Imperial Customs and Border Police to a person who has passed the border checks, with regard to whom there are no circumstances excluding the crossing of the state border, and who has met the requirements set for entry into the Lands of the Longships Throne, stay in the Twenty-Six Jarldoms and departure from the High Realm.

Article 22: Exceptions

Exceptions to the procedure provided for in the preceding Article are allowed in instances provided by an international agreement, this Act or another Act. The aforementioned procedure shall also not be extended to aircraft that cross the Storish airspace without stopping and to foreign vessels which are conducting innocent passage through the territorial sea.

Article 23: Incoming Vessels and Aircraft

Vessels and aircraft arriving in the High Realm which have crossed the state border shall navigate to a port or airport open for international traffic pursuant to the established procedure.

Article 24: (Un)loading of Passengers Cargo

Loading and unloading of goods and disembarkation of persons from a train, vessel or aircraft which has crossed the external border in an area between the border crossing point and the state border is prohibited, except upon pilotage, replenishment of motor fuel or motor oil of a vessel, delivery of bilge water, tank washing water and waste oil, saving of human lives and in the event of accidents.

Article 25: Crossing of Air Border

Aircraft shall cross the Storish state border through international airways in accordance with international agreements and pursuant to the procedure provided by or under the authority of the High King in the High Council of the Realm. An aircraft may cross the state border outside the established airway only with the permission of an agency authorised by or under the authority of the High King in the High Council of the Realm.

Article 26: Forced Landings

Persons on board an aircraft which has made a forced landing shall, if necessary, be taken to the border crossing point for border checks or shall be checked at the place of landing. In such case, the aircraft may take off with the permission of an agency authorised by or under the authority of the High King in the High Council of the Realm.

Article 27: No Violation of Merkistjórn by Aircraft

The crossing of the state border shall not be deemed to be a violation of the Merkistjórn if the aircraft crosses the state border due to a technical failure on the aircraft, an emergency, a natural disaster or another urgent situation. The aircraft captain shall be required to notify an agency authorised by or under the authority of the High King in the High Council of the Realm of the deviation pursuant to the established procedure.

Article 28: Crews of Ships and Aircraft

An outlander who leaves employment on board a ship or an aircraft, or a foreigner who has concealed himself on board, may not enter the Twenty-Six Jarldoms without the permission of the Imperial Customs and Border Police. Provisions shall be issued by or under the authority of the High King in the High Council of the Realm on shore leave for foreign mariners during a ship's stay in harbour, and on powers to deny entry ashore.

Article 29: Entry into Inland Maritime Waters, Ports and Transboundary Water Bodies

A foreign civil vessel may cross, enter or exit the inland maritime waters:

in order to proceed to an Storish port;

in order to exit an Storish port;

in order to sail from the Gulf of Finland to the Gulf of Riga and vice versa;

in order to save a human life, prevent an accident or reduce damage arising from an accident;

due to force majeure;

for bunkering.

Article 30: Mandatory Shipping Route

A foreign vessel may navigate in the inland maritime waters only along the shipping route, if established, and by using a pilot upon pilotage. The preceding provision shall not apply:

to a vessel meeting the requirements established for a pleasure boa tor cruise ship;

to vessels which enter the inland maritime waters due to force majeure, in order to save a human life, in order to prevent an accident or reduce damage arising from an accident;

if a ship proceeds to the inland maritime waters by the shortest route to take a pilot on board;

if a ship proceeds to the territorial sea by the shortest route after the pilot has disembarked;

in other cases provided by an Act regulating maritime safety.

Article 31: Penal Provision

Anyone who violates the Merkistjórn shall be guilty of the crime of Merkistjórnóvirðing and shall upon conviction thereof be liable to the punishment of Intermediate Outlawry. In the event that death results from the violation of this Article, or if the violation includes kidnapping or an attempt to kidnap, aggravated sexual abuse or the attempt to commit aggravated sexual abuse, or an attempt to kill, the defendant shall be upon conviction thereof be liable to the punishment of Full Outlawry or to the death penalty.

Article 32. Power to Make Rules and Regulations

The High King in the High Council of the Realm may make all the rules and regulations He may deem necessary or expedient to carry the purposes and provisions of this Act into effect.

Article 33: Where No Provisions

In the absence of Merkistjórnar provisions and procedures ad hoc (discretionary) measures not inconsistent with Althing Law may be taken by or under the authority of the High King in the High Council of the Realm.

Article 34: Short Title

This Act may be cited as the Statute of the Merkistjórn of Year 14.

Article 35: Commencement

This Act shall come into operation immediately after it has received the Imperial Assent.

 

In consequence of Us looking with favour upon the decision of the Althing of that Day of the Lord Thor, which is known to Us, Our Well-Beloved Royals, Nobles, Knights and Thegns, and all Our other Well-Beloved Patricians and Citizens whatsoever as the Fifth Day of the Month Sokkvabekk in the Fourteenth Year of the Second Viking Age in the Second Epoch of Our High Realm that the Law Speaker of the said Althing has most graciously laid before Us, We have assented to and confirmed, as We hereby do assent to and do confirm the same as Law under Our Hand and the Great Seal of Our High Realm.

Given at the Court of the Three Ladies Divine, since time immemorial situated at the Vanadísarhall on the holy island in the sacred river Fulltrui Flow known as Hnossa Isle which is seated within the bounds of the Imperial City of Haraldsborg in Our Jarldom of Gularike, on this Day of the Lord Thor, the Fifth Day of the Month Sokkvabekk in the Fourteenth Year of the Second Viking Age in the Second Epoch of Our High Realm.
