Act of the Althing

AN ACT TO MAKE ADDITIONAL PROVISION CONCERNING THE SUPPRESSION OF PIRACY AND PRIVATEERING ON THE HIGH SEAS OR ELSEWHERE WITHIN THE ADMIRALTY AND MARITIME JURISDICTION OF THE HIGH REALM OF STORMARK AND THE STORISH BILANDER.

Most Gracious Sovereign Lord and Ruler of all the Lands Whatsoever Where Man Can Smell the Scent of Saline Waters or Hear the Sound of Crashing Waves,

WHEREAS it seems that pirate acitivity on the Dark Side of Reikistjarna may be at the brink of an upsurge due to the quite recent emergence of new piratical groups and rogue states willing to facilitate such maritime robbing scum, constituting a significant threat to international shipping;

AND WHEREAS we, Your Imperial and Royal Majesty's Most Faithful Jarls in the Althing assembled, have most solemnly endeavoured to exercise our Supreme Legislative Authority to, for the benefit of Storish Society and that of Reikistjarna as a whole, address the potential universal and global peril aforesaid by making statutory provision to create additional tools and recourses for the enforcers of the law and other persons protecting zirselves against pirates as well as seeking justice from such seaborne marauding thugs;

NOW, THEREFORE, we, Your Imperial and Royal Majesty’s most dutiful and loyal Patricians, the Most Honourable Jarls of the High Realm in the Althing assembled, have freely and voluntarily resolved to create and establish this Statute concerning the suppression of piracy and privateering on the High Seas or elsewhere within the admiralty and maritime jurisdiction by this Act of ours and through the provisions of the Act aforesaid provide for the statutory punishment of piracies as well as lawful self-defense from pirate attacks and civil remedies against the same, and we do most humbly beseech Your Imperial Valtian Viking Majesty that You may be graciously pleased to assent to and confirm as Law the following decision of Your Most Faithful Althingi Jarls:

Article 1: Piracy under Law of Nations

Anyone who, on the High Seas, engages in acts of piracy, as defined by the Law of Nations, and is afterwards brought into or found in the High Realm of Stormark or any of the Storish Bilander, shall be guilty of the crime of Piracy and shall upon conviction thereof be liable to the punishment of Full Outlawry. In the event that death results from the violation of this Article, or if the violation includes kidnapping or an attempt to kidnap, aggravated sexual abuse or the attempt to commit aggravated sexual abuse, or an attempt to kill, the defendant shall be upon conviction thereof be liable to the punishment of Full Outlawry or to the death penalty.

Article 2: Storish Pirates

Anyone who, being a Patrician or Citizen of the High Realm of Stormark or of any of the Storish Bilander, commits any murder or robbery, or any act of hostility against the High Realm of Stormark or any of the Storish Bilander, or against any Patrician or Citizen thereof, on the High Seas, under colour of any commission from any foreign prince, or state, or on pretense of authority from any person, shall be guilty of the crime of Piracy and shall upon conviction thereof be liable to the punishment of Full Outlawry or to the death penalty.

Article 3: Outlandish Pirates

Anyone who, being a national, citizen or subject of any foreign state, is found and taken on the sea making war upon the High Realm of Stormark or any of the Storish Bilander, or cruising against the vessels and property thereof, or of the Patricians and Citizens of the same, shall be guilty of the crime of Piracy and shall upon conviction thereof be liable to the punishment of Full Outlawry or to the death penalty.

Article 4: Arming Privateers

Anyone who, being a Patrician or Citizen of the High Realm of Stormark or any of its Bilander, within or without the limits thereof, fits out and arms, or attempts to fit out and arm or is concerned in furnishing, fitting out, or arming any private vessel of war or privateer, with intent that such vessel shall be employed to cruise or commit hostilities upon the Patricians and Citizens of the High Realm of Stormark or any of its Bilander or their property shall be guilty of the crime of Privateering and shall upon conviction thereof be liable to the punishment of Full Outlawry.

Article 5: Serving on Privateers

Anyone who, being a Patrician or Citizen of the High Realm of Stormark or any of its Bilander, within or without the limits thereof, takes the command of or enters on board of any such vessel with such intent; or purchases any interest in any such vessel with a view to share in the profits thereof, shall be guilty of the crime of Privateering and shall upon conviction thereof be liable to the punishment of Full Outlawry.

Article 6: Piratical Assault on Commander and Crew

Anyone who, being a mariner, lays violent hands upon zir commander or zir fellow mariners, to hinder and prevent zir fighting in defense of zir vessel or the goods intrusted to zie, is a pirate, and shall be guilty of the crime of Piracy and shall upon conviction thereof be liable to the punishment of Full Outlawry. In the event that death results from the violation of this Article, or if the violation includes an attempt to kill, the defendant shall be upon conviction thereof be liable to the punishment of Full Outlawry or to the death penalty.

Article 7: Conversion or Surrender of Vessel

Anyone who, being a captain or other officer or mariner of a vessel upon the High Seas or on any other waters within the admiralty and maritime jurisdiction of the High Realm of Stormark or any of its Bilander, piratically or otherwise unlawfully runs away with such vessel, or with any goods or merchandise thereof, to the value of Rkr. 50 or over; or yields up such vessel voluntarily to any pirate, shall be guilty of the crime of Piracy and shall upon conviction thereof be liable to the punishment of Full Outlawry.

Article 8: Corruption of Mariners

Anyone who attempts to corrupt any commander, master, officer, or mariner to yield up or to run away with any vessel, or any goods, wares, or merchandise, or to turn pirate or to go over to or confederate with pirates, or in any wise to trade with any pirate, knowing him to be such; shall be guilty of the crime of Piracy and shall upon conviction thereof be liable to the punishment of Intermediate Outlawry.

Article 9: Confederating with Pirates

Anyone who furnishes a person knowing zie to be guilty of any piracy or robbery with any ammunition, stores, or provisions of any kind; or fits out any vessel knowingly and, with a design to trade with, supply, or correspond with any pirate or robber upon the seas; or consults, combines, confederates, or corresponds with any pirate or robber upon the seas, knowing him to be guilty of any piracy or robbery; or being a mariner, confines the master of any vessel, shall be guilty of the crime of Piracy and shall upon conviction thereof be liable to the punishment of Intermediate Outlawry.

Article 10: Plunder of Distressed Vessel

Anyone who plunders, steals, or destroys any money, goods, merchandise, or other effects from or belonging to any vessel in distress, or wrecked, lost, stranded, or cast away, upon the sea, or upon any reef, shoal, bank, or rocks of the sea, or in any other place within the admiralty and maritime jurisdiction of the High Realm of Stormark or any of its Bilander, shall be guilty of the crime of Piracy and shall upon conviction thereof be liable to the punishment of Full Outlawry.

Article 11: Obstruction of Escape from Distressed Vessel or Wreck

Anyone who willfully obstructs the escape of any person endeavoring to save his life from any vessel in distress, or wrecked, lost, stranded, or cast away, upon the sea, or upon any reef, shoal, bank, or rocks of the sea, or in any other place within the admiralty and maritime jurisdiction of the High Realm of Stormark or any of its Bilander, shall be guilty of the crime of Piracy and shall upon conviction thereof be liable to the punishment of Full Outlawry. In the event that death results from the violation of this Article, or if the violation includes an attempt to kill, the defendant shall be upon conviction thereof be liable to the punishment of Full Outlawry or to the death penalty.

Article 12: False Lights and Extinguishing True Lights

Anyone who holds out or shows any false light, or extinguishes any true light, with intent to bring any vessel sailing upon the sea into danger or distress or shipwreck, shall be guilty of the crime of Piracy and shall upon conviction thereof be liable to the punishment of Full Outlawry. In the event that death results from the violation of this Article, or if the violation includes an attempt to kill, the defendant shall be upon conviction thereof be liable to the punishment of Full Outlawry or to the death penalty.

Article 13: Attack to Plunder Vessel

Anyone who, upon the High Seas or other waters within the admiralty and maritime jurisdiction of the High Realm of Stormark or any of its Bilander, by surprise or open force, maliciously attacks or sets upon any vessel belonging to another, with an intent unlawfully to plunder the same, or to despoil any owner thereof of any moneys, goods, or merchandise laden on board thereof, shall be guilty of the crime of Piracy and shall upon conviction thereof be liable to the punishment of Intermediate Outlawry.

Article 14: Receipt of Pirate Property

Anyone who, without lawful authority, receives or takes into custody any vessel, goods, or other property, unlawfully taken by any robber or pirate against the laws of the High Realm of Stormark or any of its Bilander, knowing the same to have been unlawfully taken, shall be guilty of the crime of Piracy and shall upon conviction thereof be liable to the punishment of Intermediate Outlawry.

Article 15: Robbery Ashore

Anyone who, being engaged in any piratical cruise or enterprise, or being of the crew of any piratical vessel, lands from such vessel and commits robbery on shore, shall be guilty of the crime of Piracy and shall upon conviction thereof be liable to the punishment of Full Outlawry. In the event that death results from the violation of this Article, or if the violation includes kidnapping or an attempt to kidnap, aggravated sexual abuse or the attempt to commit aggravated sexual abuse, or an attempt to kill, the defendant shall be upon conviction thereof be liable to the punishment of Full Outlawry or to the death penalty.

Article 16: Protecting Zirself with Force against Pirates

It shall be lawful for any Patrician or Citizen of the High Realm of Stormark or any of its Bilander to use reasonable force to protect zirself, others for whom zie is responsible and zir property against piracy at any time and any place on the High Seas or elsewhere within the admiralty and maritime jurisdiction of the High Realm of Stormark or any of its Bilander as well as reasonable measures to deter and disrupt pirates.

Article 17: Mandatory Restitution

In addition to any other civil or criminal penalties authorized by Althingi Law, the Law Court shall order restitution for any offense under this Act and the order of restitution under this Article shall direct the defendant to pay the victim the full amount of the victim’s losses as determined by the court in accordance with the Act on Punishments for Crime and shall include the greater of the gross income or value to the defendant of the victim’s services or labour or the value of the victim’s labour as guaranteed by Althingi Law.

Article 18: Civil Remedy

An individual who is a victim of a violation of this Act may bring a civil action against the perpetrator (or whoever knowingly benefits, financially or by receiving anything of value from participation in a venture which that person knew or should have known has engaged in an act in violation of this Act) through the Law Courts and may recover damages and reasonable attorneys fees.

Article 19. Short Title

This Act may be cited as the Act on the Suppression of Piracy and Privateering of Year 14.

Article 20. Commencement

This Act shall come into operation immediately after it has received the Imperial Assent.

 

In consequence of Us looking with favour upon the decision of the Althing of that Day of the Lord Týr, which is known to Us, Our Well-Beloved Royals, Nobles, Knights and Thegns, and all Our other Well-Beloved Patricians and Citizens whatsoever as the Third Day of the Month Sokkvabekk in the Fourteenth Year of the Second Viking Age in the Second Epoch of Our High Realm that the Law Speaker of the said Althing has most graciously laid before Us, We have assented to and confirmed, as We hereby do assent to and do confirm the same as Law under Our Hand and the Great Seal of Our High Realm.

Given at the Court of the Three Ladies Divine, since time immemorial situated at the Vanadísarhall on the holy island in the sacred river Fulltrui Flow known as Hnossa Isle which is seated within the bounds of the Imperial City of Haraldsborg in Our Jarldom of Gularike, on this Day of the Lord Týr, the Third Day of the Month Sokkvabekk in the Fourteenth Year of the Second Viking Age in the Second Epoch of Our High Realm.
