Act of the Althing

AN ACT TO MAKE PROVISION CONCERNING THE LAW SPEAKER OF THE ALTHING OF THE LANDS OF THE LONGSHIPS THRONE.

Most Gracious Sovereign Lord and Ruler of all the Lands Whatsoever Where Man Can Smell the Scent of Saline Waters or Hear the Sound of Crashing Waves,

WHEREAS it recently has become a concern widely felt in the Lands of the Longships Throne that various important aspects of one of the most august and most senior offices of the Storish State - that of Law Speaker of the Althing of the Realm of Joy - since Time Immemorial lack statutory regulation;

AND WHEREAS we, Your Imperial and Royal Majesty's Most Faithful Jarls in the Althing assembled, have most joyously endeavoured to exercise our Supreme Legislative Authority to address the deficiencies, lacks, and needs aforesaid by making statutory provision for the same for the legal security for the current and future holders of the office of Law Speaker of the Althing of the Twenty-Six Jarldoms as well as Storish Society as a whole;

NOW, THEREFORE, we, Your Imperial and Royal Majesty’s most dutiful and loyal Patricians, the Most Honourable Jarls of the High Realm in the Althing assembled, have freely and voluntarily resolved to to create and establish this Statute concerning the Law Speaker of the Althing of the Lands of the Longships Throne by this Act of ours and through the provisions of the Act aforesaid make provision concerning the election, tenure and removal from office of the aforementioned Law Speaker as well as the pay and other perks of the senior and august Storish State office aforesaid, and we do most humbly beseech Your Imperial Valtian Viking Majesty that You may be graciously pleased to assent to and confirm as Law the following decision of Your Most Faithful Althingi Jarls:

Part 1: Election of the Law Speaker

Article 1: Election

In accordance with the ancient consuetudinary law known as Þingréttur the process concerning the election of the Law Speaker of the Althing (hereinafter "the Law Speaker") shall be commence immediately after the former incumbent has ceased to hold office.

Article 2: Term of Office

The Law Speaker shall be elected by the Most Honourable Jarls of the High Realm in the Althing assembled for an indefinite Term and serve at the pleasure of the aforesaid Ancient Company of Althingi Jarls.

Article 3: No Term Limits

No limit shall lie on the number of times that an Althingi Jarl may be elected to the office of Law Speaker.

Article 4: Functions of High King

The High King shall manage the process concerning the election of the Law Speaker and shall also be the sole and exclusive judge of the same. He may apply Udal Law to any and all matters that may arise concerning the Law Speaker’s Election that this Act does not provide for.

Article 5: Invitations to Stand for Election

The process concerning the election of the Law Speaker shall commence with the High King inviting the eligible Althingi Jarls who wish to stand for election in the forthcoming Law Speaker's Election to declare in a thread in the Látálarinrúm, especially opened by the High King for this purpose, their intention to stand for election as Law Speaker by filling up the declaration form that shall be provided by the High King. The said declaration thread shall be open for a period of time determined by the High King of at least three (3) days, but no more than seven (7) days.

Article 6: Prohibition

No person shall stand for election as Law Speaker who has not continuously been an Althingi Jarl for a period of at least one (1) year.

Article 7: Speeches

Any Althingi Jarl who has filled up a declaration form under Article 5 of this Part may post a candidacy speech on the Floor of the Althing in a separate topic. Those Althingi Jarls who wish to question a candidate may do the same in the said candidacy speech topic.

Article 8: Candidates

When the the period of time mentioned in Article 5 of this Part has passed the High King shall declare the declaration thread mentioned in Article 5 of this Part closed, declare and confirm the eligible Althingi Jarls who have declared their intention to stand for election as Law Speaker, lock the said thread, and proceed to conducting the vote to elect the Law Speaker on the Floor of the Althing.

Article 9: Election by Default

Notwithstanding Article 8 of this Part, in the event that only a single Althingi Jarl has put him- or herself forward to stand for election as Law Speaker in the forthcoming Law Speaker’s Election no vote shall be held and the said Althingi Jarl shall have been elected to the office of Law Speaker by default.

Article 10: Voting by Borda count

The Most Honourable Jarls in the Althing assembled shall elect the Law Speaker by means of the single-winner election method known as the Borda count and the candidate receiving most points shall have been elected Law Speaker provided always that in the event of a tie the High King shall have and exercise a casting vote.

Article 11: Motion to Elect the Law Speaker

Before the High King shall put the Motion to elect a fresh Law Speaker on the Floor of the Althing He shall advise the Most Honourable Jarls in the Althing assembled who the candidates standing for election as Law Speaker are. He shall also explain the method of voting. The voting on the said Motion shall be open for a period of time determined by the High King of at least three (3) days, but no more than seven (7) days.

Article 12: Refrainments

In accordance with ancient convention the High King as as well as Althingi Jarls standing for election as Law Speaker shall refrain from casting their ballots in the Law Speaker’s Election, provided always that this Article shall not apply to a casting vote exercised by the High King under Article 10 of this Part.

Article 13: Result

When the the period of time mentioned in Article 11 of this Part has passed the High King shall close the voting and subsequently announce the result of the Law Speaker's Election, both on the Floor of the Althing and in the Látálarinrúm.

Part 2: Powers, Functions and Privileges

Article 1: Presiding Officer of the Althing

(a) The Law Speaker shall be the presiding officer of as well as the judge of order in the Althing and in the Committee of the whole Althing and shall have the authority to suppress disorder and to enforce prompt obedience to his or her ruling. He or she shall also be the Commander-in-Chief of the Althingi Guard.

(B) In Standing, Select or Special Committees order shall be maintained by the Chairman, but disorder or obstruction in Committees can be punished only in the Althing on receiving a report about such incident.

Article 2: Primary Interpreter and Final Arbiter

The Law Speaker shall be the primary interpreter of the Rules and Protocols of the Althing, and the final arbiter of disputes concerning or arising within the Althing, except in the event that the Althingi Jarls successfully appeal the ruling of the Lions' Chair. The Law Speaker may call any Althingi Jarl, save for the High King and Gulajarl, to order for violating the Rules and Protocols as well as other Althingi Law governing the Most Honourable Jarls of the High Realm in the Althing assembled.

Article 3: Rule-Making Power and Udal Law

The Law Speaker shall, in addition to the power to make the Rules of Order for the Althing, have to power to make such protocols, rules and regulations as appear to him or her necessary or expedient for the purposes of carrying out his or her duties. The aforesaid stipulations shall collectively be known as the Rules and Protocols of the Althing. The Law Speaker may also apply Udal Law to any and all matters that may arise concerning the Althing that Althingi Law as well as the Rules and Protocols of the Althing do not provide for.

Article 4: Látálarinrúm

The Látálarinrúm shall continue to assist the Law Speaker in the discharge of his or her functions. The Law Speaker shall appoint such employees to the Látálarinrúm as he or she considers necessary for assisting him or her in the discharge of the functions of the office of Law Speaker. The aforesaid staff shall be appointed at such remuneration and on such other terms and conditions as the Law Speaker may determine.

Article 5: Greffier of the Althing

(a) The Law Speaker may, under his or her hand and Seal, appoint to the Látálarinrúm a Greffier of the Althing, after consultation with the High King as well as the five most senior Althingi Jarls and approval of the aforesaid appointment by Resolution of the Most Honourable Jarls of the High Realm in the Althing assembled.

(B) The Greffier of the Althing may delegate any of his or her functions, other than this power of delegation, to any Substitute Greffier or to any person prescribed by the regulations or belonging to a class so prescribed.

Article 6: Residences

The Althingi Hall shall be the official residence of the Law Speaker. The mansion in the Traditional District of the Duchy of Port Chloe and the Providence Plantations that is known as Highmeadow which is known by the name of Kjolsgard House shall be the Law Speaker’s holiday residence.

Article 7: Pay and Pension

(a) The salary of the Law Speaker shall be pegged at four-fifths of the average principal earned income of the top four earners in the following six professions: accounting, banking, engineering, law, inland manufacturing firms and multinational corporations.

(B) After leaving office any person who has served as Law Speaker shall, upon application to the High Council of the Realm, be granted a pension of three-fourths of his or her pay and he or she shall enjoy the said pension for the remainder of his or her life. The High King in the High Council of the Realm may, by Order, also confer additional rewards and compensation upon a former Law Speaker as recognition for past service.

Article 8: Transportation

The Law Speaker shall at his or her disposal a cruise ship-sized Yacht, a fleet of aircraft, a fleet of cars, and other means of transportation befitting to the august station of his or her office.

Part 3: Commencement and End of Tenure

Article 1: Entering upon Office

The Law Speaker shall enter upon his or her office immediately after the High King has announced the result of the Law Speaker's Election.

Article 2: Incumbency

The Law Speaker shall hold office until he or she dies, resigns, is removed from office by the Althing, becomes permanently incapacitated, or becomes ineligible to hold office under the High Realm of Stormark, such incapacity or ineligibility being established to the satisfaction of the Althing.

Article 3: Removal from Office

The Althingi Jarls shall have power to remove the Law Speaker from office by passing a Motion of No Confidence, or a Motion of Permanent Incapacity, or a Motion of Ineligibility. A Motion of Confidence that has been defeated by the Most Honourable Jarls of the High Realm in the Althing assembled shall also remove the Law Speaker from office. Any unannounced absence of more than seven (7) consecutive days by the Law Speaker shall be considered as resignation on the part of the Law Speaker.

Article 4: Required Majorities and Proscription

It shall require a majority of two thirds of the votes cast to pass a Motion of No Confidence. Likewise, shall it require a majority of two thirds of the votes cast to pass a Motion of Confidence. A simple majority of the votes cast shall be sufficient to pass any of the other Removal Motions provided for by Article 3 of this Part. In the event that a Motion of No Confidence fails to pass no such Motion may be submitted to the Most Honourable Jarls of the High Realm in the Althing assembled for a period of two (2) months.

Article 5: Restrictions on Submissions

(a) A Motion of Confidence may only be submitted to the Most Honourable Jarls of the High Realm in the Althing assembled by or with the consent of the Law Speaker. A minimum period of forty-eight hours shall elapse between the submission to the Althing of any Motion provided for by Article 3 of this Part before such Motion shall be put on the Floor of the Althing.

(B) The High King may refuse to put a Motion of No Confidence on the Floor of the Althing in the event that He deems that the said Motion is clearly unfounded, frivolous or dilatory or in conduct that is vexatious or quarrelsome.

Article 6: Refrainments

In accordance with the ancient consuetudinary law known as Þingréttur the High King, the Law Speaker and the Althingi Jarl submitting a Motion provided for by Article 3 of this Part shall refrain from casting their votes on such Motion.

Part 4: Final Provisions

Article 1: The Current Law Speaker

The person being the incumbent in the office of Law Speaker immediately before the coming into operation of this Act shall after the coming into operation of this Act continue in office until she ceases to hold the same due to death, resignation, permanent incapacitaty, ineligibility, or removal from office by the Most Honourable Jarls of the High Realm in the Althing assembled.

Article 2: Short Title and Commencement

This Act may be cited as the Act on the Law Speaker of the Althing of Year 13 and shall come into operation immediately after it has received the Imperial Assent.

In consequence of Us looking with favour upon the decision of the Althing of that Day of the Ladies Divine Frigga, Freyja and Idunn, Fulltrui and Sacred Queens of Stormark since time immemorial, which is known to Us, Our Well-Beloved Royals, Nobles, Knights and Thegns, and all Our other Well-Beloved Patricians and Citizens whatsoever as the Thirtieth Day of the Month Gladsheim in the Thirteenth Year of the Second Viking Age in the Second Epoch of Our High Realm that the Law Speaker of the said Althing has most graciously laid before Us, We have assented to and confirmed, as We hereby do assent to and do confirm the same as Law under Our Hand and the Great Seal of Our High Realm.

Given at the Court of the Three Ladies Divine, since time immemorial situated at the Vanadísarhall on the holy island in the sacred river Fulltrui Flow known as Hnossa Isle which is seated within the bounds of the Imperial City of Haraldsborg in Our Jarldom of Gularike, on this Day of the Ladies Divine Frigga, Freyja and Idunn, Fulltrui and Sacred Queens of Stormark since time immemorial, the Thirtieth Day of the Month Gladsheim in the Thirteenth Year of the Second Viking Age in the Second Epoch of Our High Realm.
