In this section, subsections 1 and 3 should probably be "Any citizen or patrician of Stormark" instead of "anyone", so that it's clear that the different rules for foreigners (2, 4). Otherwise, a foreigenr may be punished twice... even though the punishment may be the same. But for the sake of the courts' peace of mind :P

There are quite some differences between being banned and being imposed upon a penalty in criminal case.

Banishment

Banishment is a summary administrative measure where the High King or the High King in the High Council of the Realm can kick a foreigner out of the country for any reason and such foreigner cannot appeal that measure as matter of right in most cases, only where he is granted that right, and when appealing the measure the legal burden of proof is on him.

Patricians and Citizens are not ever subject to banishment.

Criminal Prosecution

In a criminal prosecution the legal burden of proof is on the government and the defendant enjoys considerable constitutional protections which are laid down in the Fifth Chapter of the High Law of the High Realm of Stormark such as, amongst other, presumption of innocence and nulla poena sine lege. It is therefore much harder for the government to obtain a criminal conviction than to banish a person.

Foreigners, Patricians and Citizens may all be subjected to criminal prosecution.

Numbering the sections would be helpful too. ;)

The sections are numbered in a Norwegian-Icelandic hybrid: Eins = One, Tveir = Two, etc. :flowers:
